Your Committee on Planning, to which was referred Bill No. 74 transmitted jointly with Bill No.
73 by Mayor Harry Kim per Communication No. 169, dated March 3, 2003, regarding the change
of zone request by Philip K. and Diane C. Delmer, at Ouli. South Kohala, Hawaii "fMK: 6-2-1 l
3, reports as follows:
Bill No. 74 amends Section 25-8-7 (North and South Kohalu District lone Map). Article K.
Chapter 25 (Coning Code) of the Hawaii County Code, by changing the district classitication for
approximately 5.1233 acres of land Irom an Agricultural (A-Sa) to a Residential and Agricultural
(RA-2a) zoned district.
The rectangular-shaped subject property, owned in lee by the applicants, is located in theAnekona
Estates Subdivision at the northeast corner ofAnekona and Kanehoa Street intersection, and
bordered by Kawaihae Road. The properly was previously used for cattle grazing but is no longer
used for agricultural activities.
The applicants propose to subdivide the property into two lots, 2.5616 acres and 2.1617 acres in
size. Construction on the newly created lots will begin immediately after all governmental
approvals are secured.
The LUPAG map designation is Extensive Agricultural, which allows uses for pasturage and range
lands. In 1967, with the adoption of theC.oning Code, the property and surrounding areas were
zoned Unplanned, where no sufYicient studies were conducted to adopt specitic district
classification. When the Zoning Code was adopted in 1996, all Unplanned zoned districts were
reclassitied to Agricultural 5 acres. Under the proposed State band Use Rural District and KA-2a
zoning. ohana dwellings arc permissible; however. the applicants have stated in their applications
that the restrictive covenants will prohibit ohana dwellings to preserve the residential-agricultural
ambience of the area.
The property is not located within the Special Management Arca, as it lies approximately six miles
from the nearest coastline.
The 36-lot Anekona Estates Subdivision, created on October 23, 1990, presently consists of 47
parcels. ']~he Planning Department records indicate Ohana Dwelling Permits were approved for 12
lots within the subdivision, and Tax Department records indicate there are 14 lots with CPRs.
"I~he 26-lot Kanehoa Subdivision, created on April 29, 1985, currently consists of 3H parcels, and
lies immediately to the east ofAnekona Estates. 'fhe Planning Department records indicate Ohana

Dwelling Permits were approved on 16 lots within the subdivision, and 'l'ax Department records
indicate there are 14 lots with CPRs.
Adjacent lands to the south and southeast of the property are parcels that have been recently
reclassified to Rural and zoned Residential and Agricultural (RA-2a) by the County. "I~he parcels
to the west and east are 5+ acre parcels which are within the State Land Use Agricultural District
and zoned A-Sa by the Chanty. Those lands arc in residential uses and/or arc vacant.
Surrounding lands are located within the States Agricultural and Rural Districts and the County's
A-Sa and RA-2a zoned districts. In addition to the above. the ten lot Kamuela Plantations
Subdivision lies immediately east of.Anekona Estates Subdivision: and the 26-lot Waimea
Landmark Estates Subdivision lies northward across Kawaihae Road. These subdivisions include
mixed residential uses. vacant lands and very few residential/agricultw~al uses. 'fhe ~3-unitOuli
F.kahi affordable rental housing project and the 40-IotOuli Mutual Self Hclp Housing subdivision
are located to the west of Anekona I?states Subdivision. l~he Hale Wailani Subdivision, located
west of Anekona Estates and adjacent to the housing projects is currently i~oned A-I a and the
developer proposes a 49-lot subdivision consisting of lots with a mininwm size of two acres.
The subject property and the surrounding area are "Unclassified" on the AI,ISH map. Soils within
the property are classified as "E" or "Very Poor ~ for agricultural productivity. 'I~he U.S. Soil
Survey classifies the sails as Puu Pa extremely stony very fine sandy loam with moderately rapid
permeability, medium runoff and moderate erosion hazard, which are used for pasture.
The property is located within Zone X. an area determined to be outside the 500-year flood plain.
There arc no known or recorded rare or endangered animal or plant life in the area. Because the
property was previously graded and grazed by cattle, no known archaeological, cultural or historic
sites arc on the property. 1 Iovvever. should any archaeological sites be encountered during the
course ofdevelopment. a condition will he included to require notification of the DLNR.
Access to the subject property will he from the Kawaihae Road via Anekona Street and Kanehoa
Street Kanehoa Street is a connector road which leads into Anekona Estates Subdivision and runs
parallel to Kawaihae Road. Both streets have rights-of-way width of 50 feet with a "_'0-toot wide
agricultural standard asphalt pavement with grass/gravel shoulders. Direct access to the property
is from Kanehoa Street.
Water is available through two service laterals with 5/A-inch meters.
Wastewater will be disposed of through a septic tank system, which meets the approval of the
State Department of Health.
All other utilities and services are or will be available to the subject piaperty.
Your Committee did not entertain further discussion on this measure.

Your Committee concurs with the Planning Commission and the Planning Director for
recommending a favorable consideration for the change of zone request. 'hhe change of zone
request will result in an appropriate land use pattern that will further benetit the public.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 74, and
recommends it pass first reading.
