No. 75 by Mayor Harry Kim per Communication No. 170, dated March 3. 2003. regarding the
change of zone rafucst by Theodore T. and Susan T. Herhold, at Ouli_ South Ikohala, 1 lawaii

Bill No. 76 amends Section 25-K-7 (North and South Kohala District lone Map). Article 8.
Chapter 25 (7.oning Code) of the Hawaii County Code, by changing the district classification for
approximately 6.5215 acres of land from an Agricultural (A-Sa) to a Residential and Agricultural
(RA-2a) zoned district.
hhe rectangular-shaped subject property. owned in tee by the applicants and Howard Rodgers, is
located in the Anekona [,tales Subdivision bordered by Kawaihae Road and Kanehoa Street. The
property was previously used for cattle grazing, and although there are two existing 48 square toot
greenhouses on the subject parcel, the property is no longer used for agricultural activities.
The applicants propose to subdivide the property into two lots. 2.4403 acres and 4.U8L' acres in
size. F Toward Rodgers lives in the existing dwelling on the proposed 2.4403 lot which fronts
Kanehoa Street. The applicant will be constructing a home on the other proposed lot once all
governmental approvals arc secured.
The LUPA(i map designation is Extensive Agriculturah which allows uses for pasturage and range
lands. In 1967, with the adoption of the %oning Code, the property anJ surrounding areas were
zoned Unplanned, where no suflicient studies were conducted to adopt specific district
classification. When the Toning Code was adopted in 1996, all Unplanned zoned districts were
reclassified to Agricultural -5 awes. Under the proposed State land l ise Rural District and RA-2a
zoning, ohana dwellings arc permissible; however, the applicants have stated in their applications
that the restrictive covenants will prohibit ohana dwellings to preserve the residential-agricultural
ambience of the area.
l~he property is not located within the Special Management Area. as it lies approximately 6 miles
from the nearest coastline.
fhc 36-lot Anekona Estates Subdivision. created on October 23, 1990, presently consists of
d7 parcels. 'fhe Planning Department records indicate Ohana Dwelling Permits were approved for
12 lots within the subdivision, and 'fax Department records indicate there arc 14 lots with CPRs_
including the subject property.

The 26-lot Kanehoa Subdivision, created on April 29, 1985, currently consists of 2K parcels. "I'he
Planning Department records indicate Ohana llwelling Permits were approved on I b lots within
the subdivision, and Tax Department records indicate there are 14 lots with CPRs.
Adjacent lands to the west and southwest of the property are parcels that have been recently
reclassified to Rural and zoned Residential and Agricultural (RA-2a) by the County. "I~he parcels
to the east and southeast are 5+ acre parcels, which are within the State land Use Agricultural
District and zoned A-Sa by the County. "hhose lands are in residential uses and or are vacant.
Surrounding lands are located within the State's Agricultural and Rural Districts and the County~s
A-Sa and RA-2a zoned districts. In addition to the above, the ten-lot Kamuela Plantations
Subdivision lies immediately east ofAnekona Estates Subdivision; the Kanehoa Subdivision lies
to the east ofAnekona Subdivision; and the 26-lot Waimea Landmark Estates Subdivision lies
northward across Kawaihae Road. '['here subdivisions include mixed residential uses, vacant
lands and very few residential/agricultural uses. The 33-unitOuli Ekahi affordable rental housing
project and the 40-lot Ouli Mutual Self Help housing subdivision arc located to the west of
Anekona Estates Subdivision. 'I~he Hale Wailani Subdivision. located west of Anekona 1~;states
and adjacent to the housing projects is currently zoned A-1 a and the developer proposes a -}9-lot
subdivision consisting of lots with a minimum size of two acres.
The subject property and the surrounding area are "Unclassified" on the ALISH mup. Soils within
the property are classified as "1?" or "Very Poor" Rir agricultural productivity. 'fhe l fS soil Survey

permeability. medium runolTand moderate erosion hazard. which arc used for pasture.
the propert}~ is located within lone ~. an area determined to be outside the 500-year flood plain.
7~here arc no known or recorded rare or endangered animal or plant life in the area. Because the
property was previously graded and grazed by cattle, no known archaeological. cultural or historic
sites are on the property. 1 lowever, should any archaeological sites be encountered during the
course of development a condition will be included to require notification of the DLNR.
Access to the subject property will be from the Kawaihae Road via Anekona Street and Kanehoa
Street. Kanehoa Street is a connector road, which leads into Anekona Estates Subdivision and
runs parallel to Kawaihae Road. Both streets have rights-of-way width of 50 feet with a 20-foot
wide agricultural standard asphalt pavement with grass/gravel shoulders. Direct access to the
property is from Kanehoa street.
Water is available through two service laterals with 5/8 inch meters.
Wastewater will be disposed of through a septic tank system, ~mhich meets the approval of the
State Ucpartment of Health.
All other utilities and services are or will be available to the subject property.

Your Committee did not entertain further discussion on this measure.
Your Committee concurs ~n~ith the Planning Commission and the Planning Director for
recommending a iavorabic consideration for the change of zone request. The change of tune
request will result in an appropriate land use pattern that will further benefit the public.
Your Committee on Planning is in accord with the intent and purpose of E3ill No. 76, and
recommends it pass first reading.
