Communication No. 226, dated April 24. 2003, regarding the change of zone request by.lames B.
Dusel, at Kealakche Homestead. First Series. North Kona, I lawaii "I~MK: 7-d-3: 7, reports as
follows:
Bill No. 103 amends Section 25-8- ~ (North kona Zonc Map)_ Article R, Chapter 2~ (Coning Code)
of the Hawaii County Code. by changing the district classification liir approximately ? 1.725 acres
of land from an Agricultural (A-20a) to a Family Agricultural (FA-3al and Agricultural IA-l0a)
zoned district.
~T~he rectangular-shaped subject property, owned in ice by JohnMatucha and Stel~anic Delmont. is
located in Kealakehe Homesteads. approximately 700 Icet east of Mamalahoa I lighway bordering
the Upper Government Road and two homestead roads, and approxinr~tclc 500 feet south of the
Makua Lani Christian Science School and one mile southeast from the Mamalahoa I lighway-
Palani Road junction. 'The owners of the property have authorized the applicant to submit this
change of zone rcyuest; and Mr. Duscl. is a potential purchaser ofa portion of the project site.
The applicant is seeking to subdivide the subject parcel imo two lots consisting of approximately
3 acres and 18.726 acres respectively. ~fhe applicant intends to purchase the three-acre parcel ui
construct a home and to improve the site into a fruit orchard and coffee I~rrm. "I'hc remainder of
the subject parcel will be retained by the present owners, who intend to utilize a portion of the site
for cattle grazing. Although a request to construct an additional farm dwelling could have been
submitted, the application Ibr subdivision enables the applicant to obtain financing on his own and
provides lirture conveyance ilexibilih'.
~fhe State Land Use designation is Agricultural. The LUPAG map designation is Orchards. which
include those agricultural lands though rocky in character and content support produc~icc
macadamia nuts, papaya, citrus and other similar agricultural products.
I~he Kona Regional Plan adopted b} the Planning Commission in April 198a recommends that the
project site maintains its cun~ent Agricultural designation and its minimum 30-acre lot sizes.
l~he subject parcel is not situated within the Special Management Arra.
Surrounding lands between the project site and the Mamalahoa 1lighway arc zoned A-la b~ the
County with lot sizes ranging ti~om a half-acre to lire acres. 'fo the norUi, south and cast of the

project site are lands zoned A-20a. In 1992 the Count} Council appro~rd a reyucst to change an
85.4 acres parcel with an A-20a designation to an A-l0a designation to allow its subdivision into
five parcels.
fhe property is located within lone X, an area determined to be outside the 500-year flood plain.
The ALISH designation is Other Important agricultural Land, ti-hick includes lands other than
Prime or Unique agricultural Lands that arc also of state-wide or local importance fur agricultural
use. approximately a fourth of the project site along the northeastern corner is not classilied.
hhe USDA Soil Consen~ation Services designates the soils as I lonuaulu Series, an extrenmk
stony. silty clay loam with rapid permeability. slow runoff and slight erosion heard ~tihich arc
used mainly for pasture and coffee. ~fhe Land Study Bureau's overall master productivih rating is
'Y'° or "Fair ~.
The applicant states there are no krnwvn or recorded rare or endangered animal or plant life in the
area.
An archaeological inventory survey conducted in Junc 2000 by Rcchtman Consulting idemiticd six
archaeological sites within the project site consisting of two agricultural complexes and four walls.
These were all deemed important for their informational value; however, their preservation was
not required and no further work on these sites was recommended.
Access to the subject property will be from the Mamalahoa Highway cia a homestead Road which
maintains a pavement wide of roughly 10 feet within a 20-foot wide right of way.
Water can be made availahle from the County's water system along theMamalahou I lighwuy. The
applicant has stated that two water meters hate already been purchased from the UcparUnent of
Water Supply
Wastewater will be disposed of through systems which meet the approval of the State Department
of Health.
All other utilities and services are or will be availahle to the subject pruperh.
Committee Member Curtis Tyler mentioned that he had attended the Planning Commission
meeting when this measure was heard, and that all conditions are acceptable to him. I lowevcr, he
was concerned about the severe sight distance problem un the north end of the parcel. which will
be resolved in Condition I. Ile also noted that the road is illegally gated at the moment, and
wondered if the homestead road will ever be opened up again. Sidney Fuke. representative for the
applicant, mentioned that he would get the response to that concern in writing before the next
meeting.

Your Committee did not entertain further discussion on this measure.
Your Committee concurs with the Planning Commission and the Planning Director for
recommending a favorable consideration for the change of zone reyucst. l~he change of zone
request will result in an appropriate land use pattern that will tiirthcr bend it the public.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 10~, and
recommends it pass lust reading.
