Your Committee on Finance, to which was referred Resolution No. 59-03, reports as follows:
Resolution No. 59-03, transmitted by Director of Finance William Takaba, via ('ommunication No. 185, dated
March 14- 2003, authorizes the Director of I finance to quitclaim a portion of the County's interest, and to grant a
right-of-entry to a portion of Kula'imano Homestead Road, identified as parcel I A, containing an area of
approximately 617 square feet to the State of Hawaii.
The County of Hawaii is the owner of a portion of the Kula'imano Homestead Road, which is situated at
Kula`imano and Pepe'ekeo (l'MK: 2-8-16 and 2-8 ?0). 3~he State of Hawaii Department of l7ansportation
requires this portion for its proposed highway project No. HWY-H-07-00. The highway project consists of
widening the Haw'ai'i Belt Road/Kula'imano Road intersection, which will provide Icft-turn lanes fix traffic
turning in to North and South Kula'imano Road. the installation of additional street lights, and providing adequate
sight distance for vehicles exiting North Kula'imano Road. To proceed without delay, aRight-of Fnu'y to Parcel
I A, pending die execution of the Quitclaim Deed conveying the parcel to the State- is required.
Pursuant Uh Hawaii Revised Statutes, Section 264-2, if a Counh highway is required by the State for highway
purposes, the ownership ofthc County' highway must he transferred to and vested in die State without
compensation.
hhe Hawaii County Charter. Section 13 ?I. requires County agencies to cooperate with Stale agencies having
similar functions.
Furthermore, pursuant to Hawaii Revised Statutes, Section 46-8, the County Council may enter into agreements
with the State government for the joint development and maintenance of projects, which have been authorized b}
the Legislature or for which monies have been appropriated by the Legislature.
Your Committee on Finance is in accord w ith the purpose and intent of Resolution No. 59-03 and recommends its
adoption.
