Attached for your favorable consideration is proposed Bill No. 235, Draft 3, with the following
amendments as discussed at today's Planning Committee meeting:
] . amend the second to the last sentence of Section K by deleting "in conjunction
with the issuance of Final Subdivision Approval" and inserting "for any portion of
the subject property".
This amendment clarifies that the recorded covenant occurs after Final
Subdivision Approval from the County. The recorded document is then submitted
to the Planning Department. This will be the standard language used in the no-
ohana subdivisions.
2. amend Condition M, on page 6, first paragraph to include Condition H and
replace "L" with "M".
This amendment would allow the cost of Condition H to be offset against the fair
share contribution in Condition M (1).
