Your Committee on Planning, to which was referred Bill No. 1 10, transmitted by Mayor
I tarry Kim per Communication No. 249, dated May 9, 2003, regarding the change of zone request
by HAKS, Inc. at Waiakea, South }lilo, f Iawai'1, TMK: 2-2-50:37 and 38. reports as follows:
Bill No. 110 amends Section 25-8-33 (City of I Pilo /one Map), nrticle 8, Chapter 25 (/oning
Code). Hawaii County Code, by changing the district classification (br approximately 45,000
syuarc reef of land from a Single Family Residential (RS-10) to an Industrial-Commercial Mixed
(MCX-20) zoned district. The MCX designation allows a mix of industrial and commercial uses.
and is intended to provide areas for diversified businesses and employment opportunities by
permitting a broad range of uses without exposing non-industrial uses to unsafe and unhealthy
environments.
fhe rectangular-shaped suhject propert}, owned in tee by Herbert ASegawa , lYust and
Kay K. Scgawa_ Trust, is located in Waiakea House Lots on the northwest corner of the Kawili
Street/I.aukapu Street inter,.ection. It is currently vacant and undeveloped.
fhe applicant is seeking to rezone hvo adjoining parcels of land consisting of 22.500 square feet
each to construct two warehouse buildings, one on each lot and separated by a tirewall, and
operate them as separate entities. As such, the applicant has no intention of consolidating. Parcels
37 and 38. Each building would be approximately 7,000 square feet in sire and consist of a single
story. "hhc structure on Parcel 38 would he mainly used for storage, and the other structure would
be a combination of a retail/warehouse or an other permitted industrial use. The structure on
Parcel 37 would be located approximatel}~ 50 fbct back from the Kawili Street boundarv. 60 feet
back from the I,uukapu Street boundary, and 25 feet back from the west property boundary. "fhe
_'4-stall parking area, includin~~ a handicapped stall will be located at the front of the building on
the Kawili Street side with a tvvo-w<q traffic circulation. 'I~he site plan rcllects two accesses I~x
two-way traffic, one at the southwest corner of the parcel from Kawili Street and the other at the
northeast corner to I,aukapu Street. On parcel 38, the building would he located approsimatcl}~
60 feet IFom the Laukapu Street boundary. 50 feet from the north propert}' boundarv and 25 feet
horn the west property boundary.
fhe Slate Land Use District designation is Urban. The Ll IPAG Map designates the area ~~>r
Industrial uses. "I'he 1989 General Plan comprchensi~'e review allowed limited expansion of
Industrial uses into this area of the Waiakea House Lots. Thereti~re. the boundary of the Industrial
i~rca designation espandcd from the Kanoelehua Industrial Subdivision to the borders of Manono
Street, Lanikaula Strcct and to hanoelehua Avenue.

~fhe property is not situated within the SMA as it lies over 1.5 miles from the nearest coastline and
outside of the tsunami inundation area.
l~he I lilo Community Development Plan adopted in 1975 designates the subject property for
residential uses, however. this plan has not been updated since, so it is not consistent with the
current General Plan.
Lands immediately to the west, north and east are zoned Single Famih Kesidcntial (KS-10) and
lands to the south arc zoned Limited Industrial (ML-2U). There are existing dwellings on adjacent
parcels to the west, north and east of Laukapu Street.
I~hc Land Study Bureau classifies the area for urban development.
~fhe suhject property is located in7.one "X", an area determined to he outside the 500-}'ear hood
plain.
Because the subject property has been previously cleared and developed, there are no known rare
or endangered plants or animals, nor arc there any historical, cultural or archaeological features on
the site.
I~he Department of Public Works recommends that access to the subject parcel be from Laukapu
Street because Kawili Street is an aitcrial and because of the development's proximity to Maka'ala
Street.
Water can be made available to the property from an existing K-inch waterline along Kawili Street
or Laukapu Street.
The applicant has indicated that they will connect to the existing County sewer lateral within
Kawili Street or Laukapu Street.
All other utilities and services are available to the site.
Your Chair circulated a communication with the follov`ing amendments:
Condition D. Delete the existing language and replace it with the proposed
language.
"Vehicular access to the subject property from Kawili Street shall be limited
to ingress only and shall be located at the eastern corner of said property, meeting
with the approval of the Department of Public Works.'
2. Condition L. nmcnd it as follows:

"A full movement [cununon] vehicular access easement between Parcels 37 and
38 or entirely on Parcel 3A shall be provided along] from Laukapu Street~,~ shall be
located at the northern corner of each of the subject properties, meeting with the
approval of the Department of Public Works. Vehicular access to the property
identified b~ Tax Map Kep: 2-2-050:038 may be situated at any other location of
said propert~~, provided that it also serves as the only Laukapu Street access to the
adioinin~property identified by Tax Map Kev: 2-2-050: 037.
Condition L nmcnd i~ as follows:

Maka'ala Street, the applicant shall coordinateits vehicular access movements with
the landowners of the adjoining [parcels] ap reel identified by Tax Map Key 2-2-
50:37 [and 38~ to provide internal traffic circulation between the proposed
developments.
Your Committee further amended Condition D. approved Conditions If and I as noted above, and
included a new Condition ~'.
The original language t~>und in Condition D was retained with a slight arnendment
"A common access easement with the adjoining parcel idurtitied by "faz Map Key
2-2-50:14 shall be provided along Kawili Street. meeting the approval of the
Department of Public Works. This common access shall be limited to fright uirn-

NeN Condition N.
"nn annual progress report shall be submitted to the Planning Director prior to the
anniversary date of the effective date of the zone change. The report shall address
the status of the development and compliance with the conditions of approval. 'this
condition shall remain in effect until all of the conditions of approval have been
complied with, and the Planning Director acknowledges that further reports are not
rcyuircd."
I~hcsc amendments will be reflected in Bill No. 110. Draft 2.
Because most of the discussion was made on the Kitagawa measure (Bill 109). Your Committee
did not entertain further discussion on this measure.
Your Committee concurs v`ith the Planning Commission and the Planning Director tier
recommending a favorable consideration for the change of zone request, which would result in an
appropriate land use pattern that will further benefit the public.

Your Committee nn Planning is in accord with the intent and purpose of Bill No. 1 10, as amended
to Bill No. 1 ] 0, Dratt 2, and recommends it pass first reading.
