I-Iawai'i TMK: 2-2-35: ;1, reports as follows: Bill No. 111 amends Ordinance No. 91-38, which reclassified 11,450 square feet of land from a Single Family Residential (RS-10) to a Limited Industrial (ML-10) zoned district. Bill No. 1 I 1 proposes to amend Conditions B and D (Final Plan ~~lpproval and required roadway improvements). The original change of zone request enabled the applicant to remove and/or demolish an existing dwelling and construct an approximately 4,800 square foot building consisting of a warehouse and office on the subject parcel. I-Iowever, the plans never materialized and no activity has taken place on the site. In 2000, the former owner/applicant, David Okano, sold the subject parcel to Mel-Brian T. ~Iirayama, who operators an electrical business on the adjoining parcel. Mr. I-Iirayama resides on the, subject property in the exiling dwelling and wishes to expand the dwelling in order to utilize it as a watchman or custodian quarters for the business. On December 5, 2002, the Planning Department informed the applicant that the existing dwelling is a non conforming use a~-rd cannot he expanded, unless it is used for caretaker purposes. On ,lanua~y 17, ?003, the Planning Department informed the applicant that the expansion of the existing dwelling would be allo~~~ed if the subject property were consolidated with the adjoining lot where the business is, so an application to consolidate parcels 31 and 99 was submitted on February 18, 2003. The rectangular shaped property, located in~aiakea House Lots lies on the west side ofKalanikoa Street approximately 100 feet north of its intersection with Ilualani Street. Because the County Toning Code was revised since the original rezoning was approved, compliance with all applicable requirements such as setback, height and landscaping is required. All other utilities and services are available to the site. The request would not adversely impact the industrial land use pattern in the Waiakea 1-louselots area. The granting of this request would not be contrary to the original reasons for granting the change of zone request. Communication 250 Bill 111 Page 2 Your Committee concurs with the Planning Commission and the Planning Director for reconunending a favorable consideration for the change of zone request_ which would result in an appropriate land use pattern that will further benefit the public. Your Committee also notes that a statement in the cover letter from the Planning Commission stating "In addition, to provide ample time to submit plans for Final Plan Approval, it is recommended that Condition B be amended to state afive-year time period to secure Final Plan Approval instead of the current one-year time period." was inadvertently included because it is not pertinent to this measure. Your Committee on Planning is in accord with the intent and purpose of Bill No. 1 I I. and recommends it pass first reading.
