Rill Nu. 122 b~ Mayor I tarry Kim, per Communication No. 278. dated June 23, 2003. regarding
the change of zone request by Gregory- K. Mooers, at Ouli. South kohala. I lawaii 'fMk: 6-2-

Rill No. 12 ± amends Section 35-8-7 (North and South Kohala Districts /,one Map), Article 8,
Chapter? ("Coning Code) of the Hawaii County Codc, by changing the district classification ibr
approximately 5 acres of land ti~om an Agricultural (A-Sa1 to a Residential and Agricultural
(RA ?a) zoned district.
The somewhat rectangular-shaped subject property, owned in lee b~ David C. andDorinda S.
Hamilton_ and Craig "h. and Ronnie R. Paultler. is located in the Anekona I~states Subdivision on
the south side of Kanehoa Street. 'fhe owners have consented to the request to subdivide the
property into two lots approximately two acres in size. The property is currentlyCPR'd into two
units. and once the subdivision is approved, the CPR will be eliminated. "hhe applicant intends to
construct ^ dwelling on one of the proposed lots.
The State Land Use Designation is 4gricultural and the joint bill is seeking to change the zoning to
Rural. 'I~he LUPA(; designation is Extensive Agricultural. Althoughohana dwellings arc
permitted in the SLl ~ Rural designation, the subdivision's restrictive covenants will prohibit ohana
dwellings.
l~hc property is not situated within the Special Management Areu as it lies sis miles From the
nearest coastline.
Surrounding lands arc located within the State's Agricultural and Rural Districts and in the
Count}~s Agricultural (A-5a) and Residential and Agricultural (RA-?a) zoned districts. l~hc
Kanehoa Subdivision lies immediately cast of the 36-lot Anekona I?statcs Subdivision. "fhe 10-lot
Kamucla Plantations Subdivision lies further cast, and the 26-lot Waimea Landmark I{states
Subdivision lies north across the Kawaihae Road. 'these subdivisions include vacant lands. mixed
residential uses. and few residential liericultural uses.
fhe Land Study Bureau classifes the soil as "I'`~ or "Very Poor°. "hhe l i S Soil Survcv classifies
the soils as Puu Pa extremely stony eery tine sandy loam with moderately rapid permeability.

l~he subject property is located in lone °X", an area determined to be outside Uic 500 scar Ilood
plain.
Because the property vv~as previously grubbed and graded, no known rare, threatened or endangered
species have been known to inhabit the site.
An archaeological licld inspection h~ Kechtman Consulting ibund that °thc property was
extensively graded for development and preciously used fin' cattle grazing.° so it is expected that
no archaeological or historic features exist on the property.'
Access to the property is From Kanrhoa Slrect via Ikawaihae Road.
County water is available ~o the subject property through two approved meters. One of the meters
is being relocated to comply with the Department of Water Supply's requirements for the
placement of meters to sen~ice the proposed two lots.
As there is no municipal sewer s~stcm in the area, wastewater will be disposed of in a septic tank
sy-stem meeting the standards and requirements of the State Department of I Iealth.
All other utilities and services ^rc available to the site.
Committee Member Curtis l~~ier noted that the background infin~mation staled that nr(m agencies
and associations did not respond . Gregory Mooe(s explained that the responses came in after the
background intbrmation was prepared but prior to the Planning Commission meeting.
Mr. 'I}ter also noted that the language in Condition I{ is something new, hecausc he has never seen
it used bcibre.
Your Committee did not cutertain fiu~ther discussion on this measure.
Your Committee concurs ~~ ith the Planning Commission and the Planning Director tier
recommending a favorahle consideration Ibr the change of zone request, which would result in an
appropriate; land use pattern that will further benefit the public.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 123, and
recommends it pass first reading.
