Chapter 35 (Coning Code) of the Hawaii County Code. by changing the district classitication tier approximately 7.315 acres of land f"rom an Agricultural (A-.;a) to a Residential and Agricultural (RA-1 a) zoned disU~ict. I~hc somewhat rectangular-shaped suhject property. owned in fee byhabumoto llriu_ I.LC_ is located on the makai side of Mamalahoa I lighway. approximatcl} 150 feet northwest of the ti1amalahoa Highway-Kaloko I)ri~c intersection. l"he applicant is the managing member of the group. The properties arc vacant and ha~c been preciously grubbed ~u grow coti~cc and raise I iccstock. l"hc applicant is seeking to ,ubdivide the properties into four lots ranging in size from I .~ l0 2.1 acres on which to construct single family dwellings. fhe LUPAG Map designation is Urhan I?xpansion, which allows a mix of high density". medium density. low density, industrial and/or open designations in areas where new settlements may be desirable, but where the spccitic sculcmcnt pattern and mix of uses ha~c not yet been dctcnnined. hhc Kona Community Uccclopment plan designates the area Ibr residential uses. \Ithough ohana dwellings are penniucd in this district, restrictions will he placed to prohibit any additional dwellings or CPR's. to prescnc the residential/agricultural ambience of the area and to limit the increase in dcnsih . In .Ianuary 3003. Dr. Ron'fern and Dr. Patrick I tart conducted a biological reconnaissance and concluded that there are no rare plan) species on the subject property. In 1999, Marc Smith ofthe Department of Land and Natural Resources I Iistoric Preservation Division conducted a study and lixmd that there are no historic sites remaining on the subject site, and because the property was previously grubbed and used fbr limited agricultural purposes, it is cspectcd that no archaeological or historic features exist on the site. :~cccss to the subject property is from Mamalahoa I lighway and the OId Government Road along the eastern boundary, and from 1lornestead Road along the northern boundary. The Police Deparunent has some concerns regarding the ingress and egress from the proposed subdivision onto Mamalahoa Highway, and recommends that improvements, meeting with both State and Counri~ requirements, be constructed al the intersections. According to the Department of Water Supph~, water can be made a~ ailable from the existing system on Mamalahoa -lighway. there is no municipal sewer system in the area. Wastewater will be disposed of by individual wastewater systems meeting the standards and requirements of the Slalc Department of I Icalth. \II other utilities and services arc a~ailahle to the suhjecl property. Discussion ensued about the access to the property and how the fair share contribution should be applied. Commirice Member .toe Rcy Holds suggested that Condition E? he amended by applying the lair share contributions to the Kaloko/Mamalahoa Flighwac intersection improvements, and Your Conunittee agreed. Committee Member James Arakaki sought to ensure that the amount of the lair share contribution was justified, so Your Chair explained that similar to precious Kaloko i~onings, we have used the standard language which includes a specific section stating the funds would be used for the intersection improvements. Greg Moocrs, representative fix the applicant recommended that Condition P include the phrase °to more than one lot' in the first sentence. so it reads: "Homestead Road, if used to provide access. to more than one lot. shall...~~_ and Your Committee agreed. l~he amendments proposed and agreed upon by Your Conunittcc today will be reftccted in Bill No. 130, Draft 2. Communication 291 13111 130 Page 3 Your Committee did not entertain further discussion on this measure. Your Committee concurs with the Planning Commission and the Planning Director fiir recommending a favorable consideration ~i~r the change of zone request. which would result in an appropriate land use pattern that will further benefit the public.
