Communication No. 307 and attached Resolution No. 92-03, reports as f~>Ilows:
Communication No. 307 dated august S. 2003 is ii~om William Takaba. Director of the
Department of Finance, transmitting Resolution No. 92-03 for Council consideration.
The purpose of Resolution No. 92-IU is to authorize the abandonment and disposition of a
roadway reserve to abutting propcrt~ owner G. Rick Robinson. 'Hie subject property is situated at
Pu'uanahulu Homesteads, north Kona and identified as being a portion of tax map key s: (3)7-1-
005-020, 022, 037. and 063. according to Resolution No. 92-03, the remnant is approximately
R77 acre, valued at $5.700 and is impractical and undesirable for the Counh to dcyelop or use
separately. 'fhe resolution also reports that the subject parcel was part ofthe Pu'uanahulu
Homestead Road which the County of I tawai'i abandoned in 1998 under Resolution 3k6-9K.
Exhibit n. a map detailing the above parcel. is also attached to Resolution No. 93-R3.
At today's meeting. F,dward Rapoza. a propert} owner abutting the roadway remnant and Stanle_c
htianuxo of the accounts Division. I~ finance Department, provided the uunmittec with a brief
commentary about the need, purpose and particulars of Resolution No. 92-03. ~1r. Rapoza
explained to committee members that the suhject pax cl would bcanne a part of a pending
property ro-subdivision and realignment project. Property owners, including himself and
Mr. Robinson. would then provide a public parking area and access route via the roadway to the
nru~by Big Island Countr}~ Cluh trails system.
Your Committee amended Kesolutinn No. 93-03, to incorporate language. which details the
I~~Ilowing items:
A perpetual and unrestricted twent}~-five foot pedestrian, equestrian, bicycle. non-
motorized public access to the Big Island Country Club Trails System and a gravel
parking area.
2. /~ perpetual rescryatiun over the parcel for public access to the Pu'u Loa-Kiholo
"frail System.
3. Indemnification ofan}~ liability of the public and County of Hawaii over an}
present or future hazardous spills or materials located on the property.

Your Committee rcyuested that the Finance DeparUncnt work with the Office of the Corporation
Counsel to incorporate the specific language before the next scheduled Council meeting.
Your Committee is in accordance with the propose and intern of Resolution No. 9?-0 ;. as
amended to Draft 2, and recommends its adoption.
