Your Committee on Finance, to which was referred Bill No. 102, reports as follows:
Bill No. 102, transmitted by Legislative Auditor Constance R Kirin, via Communication
No. 223, dated April 23, 2003, amends Chapter 2. Article 30, 1 Iawai'i County Code 1983 (1995
Edition) relating to gifts and donations.
Over the years, the County has experienced an increase in landowners wishing to donate their
property to the County. For many of the landowners, the amount of aggregate taxes paid the
County exceeds the value of their property. This is especially true for lands inundated or
surrounded by the Kilauea lava flow and eruption. While the reasons to acceptor reject such
offers may differ Isom property to property, the procedure should be consistent in principle. The
Council believes that its deliberations would be more informed if certain documentation is
submitted by the landowner and a recommendation is made from the administration. 'fhc
purpose of this measure is to establish a procedure by which the council may accept gilts or
donations of land to the County of 1 Iawai'i.
I~his proposed legislation also seeks to clarity the difference between (1) a gift and donation and
(2) the dedication of property because of development requirements.

transmitting a copy of a letter from Esther Rain, dated August 7, 2003, who hopes to hear that
the County Council has established a policy of accepting land donated by property owners.
Some members of Your Committee were concerned over the foreclosure procedures not being
adhered to when landowner defaults on real property tax payments. However. Finance Director
William Takaba informed that the cost borne by the County during foreclosure proceedings. in
the case of Lava lands, exceeds the bid price and properties have not been purchased.

Your Committee on Finance is in accord with the purpose and intent of Bill No. 102, and
recommends it pass first reading.
