Your Committee on Planning, to which was referred Bill No. 128 transmitted by Mayor Harry Kim
per Communication No. 290, dated July 18, 2003, regarding the change of zone request by Lot
Owners Within the Champion Ridge at Mauna Lani Subdivision, at Waikoloa, South Kohala,
Hawaii, TMK: 6-R-27: I. 3-7. 9-12. 16-27, and 29-35, reports as Ibllows:
Bill No. 128 amends Section 25-A-13 (Puako-'Anaeho'omalu "Lone Map), nrtide 8, Chapter 25
('Zoning Code) of the Hawaii County Code. by changing the district classification for
approximately 16.125 acres of land from aMultiple-Family Residential (RM-3) to a Single-Famih~
Residential (RS-20) zoned district.
The subject properties, owned in fee by the applicants, are located south of the Mauna Lani Resort
on Kaniku Drive, approximately 4.000 feet makai of the Queen Ka'ahumanu highway. fhe
subdivision consists of 33 lots. of which 29 arc part of this application. Of the 29 properties, I2
lots have single-family dwellings and the remaining 17 lots are vacant. Of the tour lots which are
not part of this application, single-family dwellings have been constructed on three lots. and one
remains vacant.
The change of zone would more accurately reflect the actual use of the lots within the subdivision
since all the existing structures are single-family residences and theCC&Rs state that all buildings
in the subdivision shall be used for one single-family dwelling and a private garage for not more
than three cars nor less than two cars. The covenants also prohibit secondary, guest or caretakers
units on the properties.
'fhe properties arc situated within the Special Management Area. and the existing subdivision is
included in the Special Management Area Major Use Permit No. 2. The proposed request and use
of the properties is for lower density and will not adversely impact those resources.
The properties were previously grubbed and graded as part of the development of the Champion
Ridge at Mauna Lani Subdivision, so there is no evidence of valued cultural, historical or natural
resources in the project area. Due to the subdivision's urban setting, there are no known rare.
threatened, or endangered species or endangered Iloral and fauna species. "I'he subdivision is not
used for access to the mountains or shoreline and no access to these areas will be impacted by the
proposed action.
Fhe 16'x' and 1 T~' fairways of the Mauna Lani Francis H. '1'i Brown Golf Course lie to the north
and west of the subdivision and arc zoned Open. Vacant lands to the cast and south arc zoned A-

The subject parcel lies in lone "X~~. an area determined to be outside the 500-year flood plain.
Access to the subject properties is from Mauna Lani Drive to Kaniku Drive, an existing roadway
with a 60-foot right-of=way, 8-foot wide paved shoulders. and an approximate 24-foot wide, two-
lane pavement.
Water is available from the existing Department of Water Supply system that serves the Mauna
Lani Resort.
All other utilities and services are available to the subject property.
In response to a question from Your Committee, Steve Lim. representative for the applicant.
replied that the four owners who are not part of this request did not respond. One of the four non-
respondents is a Japanese National. He also explained that the Multiple Family Residential
classification was the most appropriate choice when the original zoning was approved.
Your Committee did not entertain further discussion on this measure.
Your Committee concurs with the Planning Commission and the Planning Director,
recommending a favorable consideration for the change of zone request, which would result in an
appropriate land use pattern that will further benetit the public.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 128, and
recommends it pass tirst reading.
