Your Committee on Finance, to which was referred Bill No. 98. reports as follows:
Bill Nn. 98, transmitted by Legislative Auditor Constance R. Kiriu, via Communication No.327,
dated August 29, 2001, amends Chapter 2, Article 19, of the Hawaii County Cbde, by adding
new sections relating to Real Property Disposition.
In h'ebruary 2000, a report entitled Special Study on County of Huwui'i Leases Wilh Nonprgfit
Or~~unizalions was released. On May 3, 2000 the Hawaii County Council approved and adopted
Report No. 6 from the Committee on Human Services and Economic Development that outlined
amendments to Chapter 2 of the Hawaii County Code as suggested in the special study.
As recommended in the special study, this measure proposes to establish the Finance Department
as the central repository for all real property instruments and documents, require an annual
tenancy report to the Council, include minimum conditions of real property agreements, and
place the Council at the end of the negotiation process.
Originally heard on September 1 1, 2001, your Committee deferred this measure so that
additional lease clauses could be incorporated.
Bill No. 98, Draft 2, transmitted by Legislative Auditor Constance R. Kiriu, via Communication
No347, dated August 28, 2003, reFlects the supplementary amendments suggested by the
Finance Committee. Specifically, the following items have been included in this latest draft: 1)
Section 2, is revised to read, "Minimum Provisions and Clauses"; and 2) provisions #l, 2, 3 7, 8,
9, 12, 13 14, and 17 were added.
Your Committee on Finance is in accord with the purpose and intent of Bill No. 98, as amended
to Dratt 2, and recommends it pass first reading.
