Your Committee on Finance, to which was referred Resolution No. 128-03, reports as follows:
Resolution No. 128-03, transmitted by Director of Finance William Takaba, via Communication
No. 416, dated November 10, 2003, authorizes the payment of funds of a later fiscal year and of more
than one fiscal year for amulti-year lease of real property for the Prosecuting Attorney's Waimea
Office.
The Office of the Prosecuting Attorney wishes to negotiate a lease contract for off ice space for the
Waimea office as its current office space within the Waimea police station will no longer be made
available to them next year. Funds would be budgeted in future fiscal years to cover the anticipated
costs.
The Office of the Prosecuting Attorney has found 600 square feet of office space in the Holomau Center,
64-1067 Mamalahoa Highway, Waimea, Hawaii. A five-year lease agreement would start .lanuary 1.
2004 and end December 31, 2008, at a rental rate of $1.25 per square foot for the first year. with an
increase of $.04 per square foot for each consecutive year of the lease, plus an estimated $.35 per square
toot common area maintenance charge.
Pursuant to Section 10-i 1, Hawaii County Charter, any contract, lease or other obligation requiring
payment of funds from the appropriations of a later fiscal year must be approved by resolution.
Some members of Your Committee requested the following information from the Office of the
Prosecuting Attorney: 1) Exhibit A and B of the Insurance Requirements; 2) the loan of lease; and 3)
whether the Letter of Intent is null and void. Information is needed prior to the next Council meeting.
For informational purposes, Mr. Tyler voted kanalua twice.
Your Committee on Finance is in accord with the purpose and intent of Resolution No. 128-03 and
recommends its adoption.
