Your Committee on Finance, to which was referred Bill No. 188, reports as follows:
Bill No. 188, transmitted by Director of Finance William 7~akaba, via Communication No. 422,
dated November 18, 2002, amends Ordinance No. 03-91, as amended, the Operating Budget.
ending June 30, 2004. The amendment is as follows:

'T'he additional funds. being appropriated from the Solid Waste Fund's fund balance account. are
needed for refuse cover materials in order for the County to comply with Federal and State of
Hawaii Department of Health (DOH) regulations. The amount originally budgeted for cover
material was based on past usage and is not sufficient to achieve regulatory compliance. The
current budget was based on past usage. which was found to be inadequate by DOH. Violations
due to inadequate refuse cover resulted in the county entering into a "Consent Agreement' with
DOH. The consent agreement requires the County to document compliance with the refuse
cover regulations.
Some members of Your Committee requested a copy of the "C'onsent Agreement' prior to the
next Council meeting.
Your Committee on Finance is in accord with Use purpose and intent of Bill No. 188 and
recommends it pass first reading.
