RE: Comm. No. 424/Bill 190
Your Committee on Parks and Environmental Management, to which was referred Communication No. 424
and Bill 190, from Barbara Bel I, Director of die Department of Environmental Management, dated
November 13. 2003, reports as follows:
Communication Nu. 424jointly transmitted Bill 190 and Bill 191 1br the Council's consideration. The
purpose of Bill 190 is to transfer the solid waste fee setting authority from the County Council to the
Enviromncntal Management Commission.
Bill 190 and Bill 191 were deferred at the December 2, 2003 meeting because of language inconsistent
(outdated) with the latest version of the Hawaii County Code. A subsequent communication,
Communication Number 424.1, from Barbara Bell, dated December I, 2003.,jointly transmitting Bill 190
(Draft 2) and Bill 191 (Draft 2) was also referred for the Council's consideration. Bill 190 (Draft 2)
corrected the use of outdated language.
Steve Aragjo, of D & D Rubbish_ and Donald Leopoldino, of Leo's Rubbish, spoke against the bill. Both
stated that the responsibility for setting solid waste tees should not be shifted from the Council to the
Environmental Management Commission. Council members are elected by their constituents to set policy:
Environmental Management Commission members are appointed to advise the Department of
Environmental Management, pursuant to the Charter. Council Member Curtis Tyler, III commented that
the council members cannot delegate the authority for setting rates; it is the council's responsibility, as the
policy making body. to set rates.
A motion to defer Bill 190 and Bill 190 (Draft 2) failed.
Your Committee is not in accord with the purpose and intent of Bills 190 and 190 (Draft 2), and
recommends that they he f led.
