RE: Comm. No. 424/Bill 191
Your Committee on Parks and F.nviromnental Management to which was referred Communication No. 424
and Bill 191 from Barbara Bell, Director of the Department of Environmental Management dated
November 13, 2003_ reports as follows:
Communication No. 424,jointly transmitted Bill 190 and BiII 191 for the Council's consideration. The
purpose of Bill 191 is to transfer the sewer charges rate fee setting authority from the County Council to the
Environmental Management Commission. Bill 190 and Bill 191 were deferred at the December 2, 2003
meeting because of language inconsistent (outdated) with the latest version of the Hawaii County Code.
Communication Number 424.1, Isom Barbara Bell, dated December L 2003, jointly transmitting Bill 190
(Draft 2) and Bill 191 (Draft 2) was also referred for the Council's consideration. Bill 191 (Draft 2)
airrcctcd the use of outdated language.
Steve Araujo, of D & D Rubbish, and Donald Leopoldino, of Leo's Rubbish, spoke against the hill. Both
staled that the responsibility Tor setting sewer charge rates should not be shifted from the Council to the
Enviromnental Management Commission. Council members arc elected by their constituents to set policy;
Environmental Management Commission members are appointed to advise the Dcpmtment of
Environmental Management pursuant to the Charter. Council Member Curtis Tyler, III commented that
the council members cannot delegate the authority for setting rates; it is the council's responsibility, as the
policy making body, to set rates.
A motion to defer Bill 191 and Bill 191 (Draft 2) failed.
Your Committee is not in accord with the purpose and intent of Bills 191 and Bill 191 (Draft 2), and
recommends that they he filed.
