No. 435/Bill No. 194 Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Communication No. 435 and Bill No. 194, transmitted by Mayor Harry Kim, dated December 3, 2003, regarding a State Land Use Boundary Amendment request by Andrew J. Frogley, at Ouli, South Kohala. Hawai'i,'fMK: 6-2-11:34 (5.0012 acres) reports as follows: Bill No. 194 seeks to change the State Land Use District Boundaries Map, H-14. by changing the District Classification of approximately 5.0012 acres of land from Agricultural to Rural District. Communication No. 435 reports that the Hawai' i County Planning Commission, as required by the Hawai' i County Charter, Chapter 4, Section 6-4.3(C), considered the above request. Bill 194, and accompanying Bill No. 195 on November 7, 2003. 'fhe Commission concurred with the Planning Director's favorable recommendation on this matter. Communication No. 435, in synopsis. reports the Planning Director's findings and recommendations as the following: I~he subject property totaling 5.0012 acres is located in the Anekona Estates Subdivision created in 1990. The request is to change the State Land Use District Boundary Classification from Agricultural to the Rural District. 2.'fhe Applicant is seeking the change in order to subdivide the property into two 2-acre lots (Bill 195) and then construct a dwelling on each of the proposed lots. 3. All utilities and services are available to the property. 4. Access to the property is from Kawaihae Road to Kanehoa Street for proposed Lot B and from the existing Easement for Lot A. S.To date, the County Council has approved similar reques is tc~r State land Use Boundary Amendments and accompanying Change of Zone reyucsts for approximately eighteen parcels in the Anekona Estates Subdivision. I~he Director recommended favorably on this application for a State Land Use Boundary Amendment based on the following: The approval of the boundary amendment from Agricultural to the Rural District complements both the State Land Use District Regulations and Hawaii Land Use Commission Rules. Communication 435 Bill 194 Page 2 • The request is also supportive of the State of Hawai' i ['Ian and the Hawai' i County General Plan. ^ "fhe approval of the reclassification from the State Land Use Agricultural to the Rural District will not be violative of Hawaii Revised Statutes. Chapter 205, Section 205-2. "fhe reclassification action is not inconsistent with determining Rural District Boundaries, as the subject property is surrounded by existing Agriculture and Rural District designated lands and will be subdivided into two residential/agricultural lots. The reclassification action conforms to the socio-cultural advancement and housing objectives expressed in the Huwai' i State Plan. The reclassification action will not be inconsistent with the County General Plan as the request conforms to the [.and Use and Housing elements of the Plan. The action is also not consistent with the General Plan Land Use Pattern Allocation Guide (LUPAG) Map Extensive Agricultural designation for the area. The property is unclassified by the State of Hawaii ALISH Map as Productivity Rating for the soils in the area is "F," or "Very Poor". While the potential for intensive or extensive agricultural uses may exist, the soil conditions within the site and surrounding area would preclude such and the subject property is also not currently being used for active agricultural purposes. No geological or topographical problems have been identified on the parcel and the subject property is located outside the 500-year flood plain. The property. located six miles ti-om the nearest coastline, is not situated within the Coastal Management Area or the Special Management Area. Therefore, it is not contrary to Hawaii Revised Statutes, Chapter 205A. At today's meeting, Norman Hayashi, Planner Program Manager of the Hawai' i County Planning Department, and Gregory Mooers, representative for the applicant, provided this committee with background information about the origins and purpose of Bill No. 194. Your Committee concurs with the Planning Commission and the Planning Director's favorable recommendation for approval of the State Land Boundary Amendment from the Agricultural to Rural Districts. Communication 435 Bill 194 Page 3 Your Committee on Planning is in accord with the intent and purpose of Bill No. 194 and recommends it pass tirst reading.
