No. 435/Bill No. 195 PLACE: Councilroom TIME: 2:07 p.m. Chair and Members Hawaii County Council Itilo, Hawaii 96720 Your Committee on Planning, to which was referred Communication No. 435 and Bill No. 195. transmitted by Mayor Harry Kim, dated December 3, 2003, regarding a Change of lone request by Andrew J. Frogley, at Ouli, South Kona, TMK: 6-2-I 1:34 (5.0012-acres) reports as follows: Bill No. 195 seeks to amend Section 25-8-7. Article 8, Chapter 25 (Zoning Code) of the Hawui'i County Code. by changing the District Classification of approximately 5.0012-acres of land from Agricultural 5-acres (A-Sa) to Residential And Agricultural (RA-2a). Communication No. 435 reports Yhat the Hawaii County Planning Commission, as required by the Hawaii County Charter, Chapter 4, Section 6-43(C), considered the above request accompanying Bill No. 194 on November 7, 2003. At this meeting, the Commission concurred with the Planning Director's favorable recommendation for approval of this maucr. Communication No. 435, in synopsis, describes the Planning Director's findings and recommendations as the following: The applicant is requesting a Change of Zone lrom an Agricultural (A-Sa) to Residential and Agricultural (RA-2a) zoned district for approximately 5.0012 acres of land. 'I~hc applicant has also requested a concurrent amendment to the State Land Use District Boundary from the Agricultural to Rural District (Bill 194). 2. I~he subject property is located in the Anekona Estates Subdivision which was created in 1990. The applicant intends to subdivide the parcel into two 2-acre lots and construct dwellings will nn both lots. An EXHIBIT A through D further delineates the subject property. Access to the property is from Kawaihae Road to Kanehoa Street for proposed Lot B and from the existing Easement for Lot A. All utilities and services arc available to the property. 4. To date, the County Council has approved similar requests for Change of Lone requests for approximately eighteen parcels in the Anekona Estates Subdivision. fhe Director recommended favorably on this Change of Zone request based on the following: "fhe approval of the Change of lone request conforms with the band Use and Housing F,lements of the Hawaii County General Plan. Communication 435 Bill 195 Page 2 It is not inconsistent with the Land Use Allocation Guide (LUPAG) Map component designation of Extensive Agricultural. The approval of the Change of Zone is not volative of Chapter 205A, Hawai' i Revised Statutes relating to Coastal Lone Management Areas. Neither geological or topographical problems nor any endangered species have becn identified on the parcel. • The subject property is located outside the 500-year flood plain. • The property, located six miles from the nearest coastline, is not situated with the Coastal Management Area or the Special Management Area. "the property was previously utilized for cattle grazing, but currently is not used for any agricultural activities. The property is unclassified by the State of Hawaii ALISH Map. The productivity rating for the soils in the area is "E" or "Very Poor". • The approval of the Change of Zone request conforms with the Land Use and Housing Elements of the Hawai' i County General Plan and is not inconsistent with the Land Use Allocation Guide (LUPAG) Map component designation of Extensive Agricultural. 6. Requisite of the Planning Director's favorable recommendation for the Change of 7,one request is approximately ten conditions contained in Bill No. 195. At today's meeting, Norman Hayashi, Planning Program Manager of the Hawaii County Planning Department, and Greg Mooers, representative of the applicant, provided this committee with background information about the origins and purpose of Bill No. 195. During discussion this committee requested that to ensure consistency, Mr. Hayashi confer with the Planning Director regarding the application of fair share contributions for this particular application. Your Committee concurs with the Planning Commission and the Planning Director's favorable recommendation for approval of the Change of Lone request. Communication 435 Bill 195 Pagc 3 Your Committee on Planning is in accord with the intent and purpose of Bill No. 195 and recommends it pass tirst reading.
