Your Crnnmittee on Planning, to which was referred Communication No. 443 and Bill No. 203, transmitted
by Mayor Harry Kim, dated December 16, 2003, regarding a Change of Zone request by Hawaii Brewery
Development Co., Inc, at Keaau, Puna, Hawaii TMK: I-6-141:1 (14.587 acres) reports as follows:
Bill No. 203 seeks to amend Section 25-8-22, Article 8, Chapter 25 (Zoning Code) of the I lawaii County
Code, by changing the District Classitication of approximately I A.S87 acres of land from Agricultural 20-
acrc (A-20a) to Agricultural 5-acre (A-Sa).
Communication No. X43 reports [hat the Hawaii County Planning Commission, as required by the Hawaii
County Charter. Chapter 4, Section 6-43(C), considered the above request on November 21.2003. At this
meeting. the Commission concurred with the Planning Director's favorable recommendation for apprmal of
this matter. Communication No. 443, in synopsis, describes the Planning Director's findings and
recommendations as the following:
fhe applicant is requesting a Change of Lone from an Agricuhural 20-acre (A-20a) to Agricultural
5-acre (A-Sa) coned district for approximately 14.587 acres of land.
'The subject property is located on the old Slaughter House Road_ otTHighway 11, in Keaau.
Puna, Hawaii. Exhibit A delineates die subject property.
The Hawaiian Natural Water Co., Inc., a water bottling facility, currently operates on the subject
parcel.
'The applicant intends to subdivide the subject parcel into two parcels. This will allow the water
bottling facility to be located on one of the parcels and the further commercial development of
an additional brewery, as a separate entity, on the remaining lot Special Permit No. 8d2 has
been issued for the planned brewery facility on the subject parcel.
• Access to the properties will be from the Old Volcano Highway and the Slaughterhouse Road.
All utilities and services are or will be made available to the property.
"The Director recommended favorably on this request based on the billowing:
The Change of Zone request from Agricultural 20-acre (A-20a) to the Agricultural 5-acre (A-Sa)
"Coned District is consistent to the goals. policies and standards of the General Plan Economic
and Land Use Elements.
The band Use Allocation Guide (LUPAG) Map designates the subject area as Low Density
Urban. The subject action will coincide with activities currently underway on surrounding
parcels; therefore will not frustrate the long-term low density goals envisioned for the area.

At least six Special Permits have been issued for similar commercial and or industrial operations
in the same area.
The State of Hawaii, Department of Land and Natural Resources Historic Preservation Division,
reports that there are no historic properties that will be adversely affected by the change of zone
action.

6. Requisite of the Planning Director's favorable recommendation for the Change of Zonc request is
approximately ten conditions contained in Bill No. 203.
At today's meeting, Norman Hayashi, Planning Program Manager, and Sidney Fuke, representative of the
applicant, provided this committee with background information about the origins and purpose of Bill
No. 203.
During discussion, members of this committee questioned the appropriateness of approving the Change of
Zone request to Agricultural 5-acres in contrast to the present Low Density Urban LUPAG Designation.
This committee requested that the Planning Department seek counsel and comment on the matter from the
Office of the Corporation Counsel.
Your Committee concurs with the Planning Commission and the Planning Director's favorahle
recommendation for approval of the Change of Zone request.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 203 and recommends it
pass first reading.
