Your Committee on Public Works and Intergovernmental Relations, to which was referred Communication
No. 476 and attached Resolution No. 149-04, reports as follows:
Communication No. 476, dated January 21, 2004, is from Deputy Corporation Counsel Patricia O'Toole,
transmitting Resolution No. 149-04 for Council consideration.
The purpose of Resolution No. 149-04 is to authorize the acceptancc of Roadway Lot E, situate at Kealakehe,
North Kona, Island, County and State of Hawaii.
According to Communication No. 476, the County requested the parcel from the State of Hawaii for roadway
improvements planned in Kaloko Industrial Park Area. The State of Hawaii has agreed to transfer the subject
property as evidenced in the grant attached to the Resolution. The land patent grant has been reviewed by the
Department of Public Works, the Department of Water Supply and the Planning Department and all have
recommended acceptance of the land patent grant.
Your Committee requested that Department of Public Works staff clarity the applicability of the requirements
under Chapter 23 -Subdivision of the Hawaii County Code for review at the meeting of the Council.
Your Committee is in accord with the purpose and intent of Resolution No. 149-04 and recommends its
adoption.
