Your Committee on Finance, to which was referred Resolution No. 156-04, reports as follows:
Resolution No. 156-04, transmitted jointly with Bill No. 229 by Director of Finance William l'akaba, via
Communication No. 501, dated February 4, 2004, authorizes the Office of the Mayor to enter into an agreement
with the United States of America for its Large Capacity Cesspool Replacement Project for Hawaii County.
The United States of America through the United States Environmental Protection Agency (EPA) has authorized
a $76,000 grant to the County of Hawaii for a large capacity cesspool replacement project for Hawaii County,
Phase One.
On December 7, 1999 the EPA had promulgated a regulation prohibiting the construction of new large capacity
cesspools, and a requirement that all large capacity cesspools must be closed or upgraded by April 2005 to
prevent the endangerment of underground sources of drinking water. This project involves working with
communities or other entities that presently utilize non-government large capacity cesspools for their wastewater
disposal. 'I'bis effort will create a preliminary inventory of existing and potential non-government large capacity
cesspools- conduct an outreach/education program regarding the ban, and assist owners with selecting alternative
systems, any necessary paperwork, and possibly identitication of funding sources, in the nine (9) County
designated districts.
Pursuant to Section 46-7, Hawaii Revised Statutes, cowity departments must obtain the consent of the council to
enter into agreements with [he federal or state governments respecting action to be taken pursuant to any of the
powers granted by law to furnish, expend and receive any funds or other assistance in connection with prujects
being or to be undertaken pursuant to those powers.
During its discussion, Your Committee learned Mr. Dennis Tulang, who has been working voluntarily since early
2003, was recently hired part-Cime as the project manager.
For informational purposes, Mr. Tyler voted kanalua twice.
Your Committee on Finance is in accord with the purpose and intent of Resolution No. 156-04 and recommends
its adoption.
