Your Committee on Finance, to which was referred Resolution No. 170-04, reports as follows:
Resolution No. 170-04, transmitted jointly with Bill No. 246 by Director of Finance William Takaba, via
Communication No. 550, dated March 4, 2004, authorizes the Office of the Mayor to enter into an agreement with
the United States of America for the Substance Abuse & Mental Health Services Administration (SAMHSA)
grant for the Hawaii Island Adolescent Treatment program.
SAMHSA an agency of the U.S. Department of Health & Human Services, through its sub-agency, Center for
Substance Abuse Treatment (CSA'f) has authorized an $893,987 grant to the County of Hawaii for an adolescent
treaument program. These funds will be used to establish an adolescent treatment center on [he Island of Hawaii
aimed at preventing crystal methamphetamine use on this island.
Pursuant to Section 46-7, Hawaii Revised Statutes, county departments must obtain the consent of the council to
enter into agreements w ith the federal or state governments respecting action to he taken pursuant to any of the
powers granted by law to furnish, expend and receive any funds or other assistance in connection with projects
being or to be undertaken pursuant to those powers.
During its discussion, some members of your Finance Committee requested the Mayor's Executive Assistant
Billy Kenoi obtain answers to the following questions prior to the next Council meeting:
l . It is legal for the County to be involved with establishing the adolescent treatment center facility? Please
provide a written opinion from Corporation Counsel.
2. Would the County be in violation of the procurement code if service providers who provided information
to help draft the RFP submit proposals'?
3. Could the County be held liable for any incident at the proposed facility?
For informational purposes, Mr. Tyler voted "kanalua," then "no."
Your Committee on Finance is in accord with the purpose and intent of Resolution No. 170-04 and recommends
its adoption.
