No. 169-04 <br />PLACE: Council Chambers <br />T[Ml:: 11:15 a.m. <br />Council Chair and Members <br />Hawaii County Council <br />Hilo, Hawaii 96720 <br />Your Committee on Finance, to which was referred Resolution No. 169-04, reports as follows <br />Resolution No. 169-04, transmitted by Director of Finance William Takaba, via Communication <br />No. 547, dated March 1, 2004, authorizes the grant of easement for retaining wall purposes at <br />Kona Heights subdivision, Increment II. FP 1072 Hienaloli 5'" & 6`~. North Kona, Island, <br />County and State of Hawaii Tax Map Key No. (3) 7-5-29: Portion of Aloha Kona Drive and <br />Nele Place, to Ms. Beth Ann Frye. <br />The County of Hawaii is the owner of that certain roadway parcel located in the Kona I Ieights <br />Subdivision Increment Il, at Hienaloli, North Kona, Island, County and State of Hawaii, known <br />as Aloha Kona Drive and Nele Place. <br />The retaining wall owned by Ms. Beth Frye along the northeasterly boundary of the Aloha Kona <br />Drive and Nele Place intersection encroaches into the public right-ot=way. Ms. Beth Ann Frye <br />needs the grant of casement to maintain her retaining wall along the northeasterly boundary of <br />the Aloha Kona Drive and Nele Place intersection within the public right-of-way. An <br />independent appraiser determined that the fair market value of the retaining wall easemeut is <br />$572.00 with an area of 29 square feel. <br />Pursuant to Section 2-1 1 L Hawaii County Code, the council may, by resolution, as approved by <br />a majority of its members. dispose of real property. <br />Originally heard on March 16, 2004, this measure was deferred pending an answer to whether <br />the sidewalk meets the ADA accessibility standards. Also. a written explanation as to why the <br />wall was built on County property was requested. <br />Resolution No. 169-02, Draft 2 was referred to Your Committee, via Communication No. 547. <br />dated March 22, 2004, from Director of Finance William Takaba, which deletes the word "its' <br />and replaces it with "her" in the fourth WHEREAS and the NOW, THEREFORE, BF, IT <br />RESOLVED clauses. <br />Also attached to Communication No. 547.1 is a letter to Mr. Klaus D.
