Your Committee on Public Works and Intergovernmental Relations, to which was referred
Communication No. 558 and attached Resolution No. 172-04, reports as follows:
Communication No. 558 and attached Resolution No. 172-04 is from Gerald Takase, Assistant Corporation
Counsel, dated March 18, 2004, submitting for approval a resolution authorizing the acquisition of private
properties by eminent domain for the Kawailani Street Bridge replacement.
The purpose of Resolution No. 172-04 is to authorize the acquisition of private properties by eminent domain,
being portions of Tax Map Keys: (3) 2-4-003-022, 2-4-063-120, and 2-4-063-121, situate at'Waiakea, District of
South Hilo, for the Kawailani Street Bridge replacement.
According to Resolution No. 172-04, the proposed Kawailani Street Bridge replacement is necessary to prevent
future flooding and to address concerns of public health, safety and welfare caused by the flooding, which
constitutes a valid public purpose and use which will benefit the County of Hawaii.
For informational purposes, Mr. Tyler voted Kanalua times two. Your Committee is in accord with the purpose
and intent of Resolution No. 172-04 and recommends its passage on first reading.
