Your Committee on Finance, to which was referred Bill No. 253, reports as follows:
Bill Nn. 2~3, transmitted by Director of Finance William "1'akaba, via Communication No. 56A, dated March 23,
2003, amends Chapter 2 and Chapter 18 ofthe Hawaii County Code 1983 (1995 Edition), as amended, relating to
Administration and to Mass Transit.
This measure proposes to amend Chapter 2, Article 2, Section 2-7. "Organization of executive branch°, by
properly identifying the departments and agencies under the direct or administrative supervision of the managing
director, instead of the Mayor, pursuant to the 2000 Charter Amendment Por consistency, it also amends
Chapter 2. Article 14. by replacing "mass transportation" and "transportation coordinator" with "mass transit' and
"mass transit administrator" respectively.
Furthermore, this measure amends Chapter 18, Article I, Division I, Section 18-4 to change the mass transit
administrator position from exempt to civil service and to note it as the agency's chief administrator.
Originally heard on April 6, 2004, this measure was deferred pending an opinion from the Corporation Counsel as
to whether legislation is required to convert the Mass Transit Administrator position from an exempt to civil
SCI'V ICC STATUS.
Deputy Corporation Counsel Bobby-Jean Leithcad=Todd informed your committee that the tlawai'i Revised
Statutes states that the Civil Service Administrator may examine positions to determine whether it is correctly
classified as a civil service or exempt position.
Michael Ben. added that the Department of Civil Service examined the functions and responsibilities of the
transportation administrator. It was determined that while other departments have a multitude and variety of
functions, the Mass Transit Department is more specialized function and should be converted.
Some members of Your Committee felt that this position should he exempt.
Your Committee on Finance is in accord with the purpose and intent of Bill No. 253 and recommends it pass first
reading.
