No. 599/Bill No. 263 Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Communication No. 599 and Bill No. 263, transmitted by Leonard Bisel, Chairperson, Hawaii County Arborist Advisory Committee, dated April 1, 2004, regarding Chapter 14, relating to Exceptional Trees, reports as follows: Bill No. 263 seeks to amend Section 14-63 (Violation and penalty), Article ] 0 (Exceptional Trees), Chapter 14 (General Welfare) of the Hawaii County Code, by adding language to address incidences in which exceptional trees are substantially damaged. Communication No. 599 reports that the Hawaii County Arborist Advisory Committee, after reviewing the existing exceptional tree ordinance, unanimously determined that language to strengthen the section is warranted. According to the Committee, trees deemed "exceptional" in the County are usually very old and irreplaceable or of a rare specimen. As such, they are deserving of additional legislative protection. The purpose of Bill No. 263 is to this end. The proposed amendment seeks to expand the applicability of the present ordinance penalty to incidences as well as per tree and to situations in which a tree is not removed or destroyed, but only vandalized. Your Committee also received public testimony in relation to Bill 263. Your Committee concurs with the Hawaii County Arborist Advisory Committee's recommended amendments to the Hawaii County Code, Chapter 14, Article l0, Section 14-63, relating to Exceptional Trees. Your Committee on Planning is in accord with the intent and purpose of Bill No. 263 and recommends it pass first reading.
