Your Committee on Planning, to which was referred Communication No. 610 and Bill No. 209,
transmitted by Mayor Harry Kim, dated April 20, 2004, regarding a Change of Zone Request by Janice
Oshiro, at Waiakea, South Hilo, Hawaii, TMK: 2-2-35:73, reports as follows:
Bill No. 266 seeks to amend Section 25-8-3 (City of Hilo Zone Map), Article 8, Chapter 25 (Zoning Code)
of the Hawaii County Code, by changing the District Classification of approximately 12,787 square feet
of land from Open (O) to Industrial-Commercial Mixed (MCX-10) District.
Communication No. 610 reports the Hawaii County Planning Commission, as required by the Hawaii
County Charter, Chapter 4, Section 6-4.3(C), considered the above request on April 2, 2004. The
Commission concurred with the Planning Director's favorable recommendation on this matter.
Communication No. 610, in synopsis, reports the Planning Director's findings and recommendations as the
following:
1. The applicant, Janet Oshiro, is requesting a Change of Zone amendment from Open to Industrial-
Commercial Mixed Use (MCX-10) for approximately 12,787 square feet of land.
2. Kanoelehua Avenue, Hualani Stree[ and Railroad Avenue in Waiakea, South Hilo, border the
subject property. There are no structures on the site currently. The site is level and triangular in
shape. The area had been previously cleared and used for storage during the construction of
Kanoelehua Avenue.
3. The applicant is seeking the amendment in order to develop a I ,700 square-foot two-story office
building on the site. The structure is not anticipated to exceed 30 feet in height and will have a
minimum of nine stalls. Construction is proposed to commence this year and cost an estimated
$300,000.
4. Proposed access to the project is through Hualani Street.
5. All utilities and services are available to the project site.
6. The approval of the Change of Zone request will conform to Land Use Elements of the General
Plan based on the following:
The LUPAG designation for the area is Industrial. The Industrial-Commercial Mixed District
would allow for a mixture of light industrial and commercial uses. The proposed project is
consistent with and would further complement the existing uses in this area. Businesses in the
immediate area are a mix of commercial and industrial uses, including aviation, warehouse
and office operations.

• The goals, policies and standards of the General Plan, Industrial sub-element, states that
"Industrial development shall be located in areas adequately served by transportation, utilities
and other amenities". The proposed request also conforms to this standard.
• The approval of the Change of Zone request is not in contrary to Section 205-2, Chapter 205,
Hawaii Revised Statutes. The property is not situated within the Special Management Area.
• Land Study Bureau's Productivity Rating for the Property is Urban.
• "There are no known recreational, historic, cultural, archeological features or endangered
species or fauna on the parcel.
• The subject property is located outside the 500-year flood plain.
Requisite of the Planning Director's favorable recommendation for the Change of Zone request are
approximately eighteen conditions contained in Bill No. 266 that outline specific infrastructure
and access route requirements for the project.
At today's meeting, Planning Director Chris Yuen and Sidney Fuke, representative of the applicant,
provided background information about the purpose of Bill No. 266.
During discussion, members of this Committee inquired further about allowable access routes to the
project site. Of particular concern was the parcel's proximity to Railroad Avenue and Kanoelehua
Avenue and the conditions of use for both roadways. Mr. Yuen explained that he would review whether
current access conditions contained in Bill No. 266 require further delimitation.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 266 and recommends it
pass first reading.
