Your Committee on Finance, to which was referred Resolution No. 150-04, reports as follows:
Resolution No. 150-04, transmitted by Deputy Corporation Counsel Patricia O'Toole, via Communication
No. 490, dated February 2, 2004, authorizes the acceptance of a donation of real property from Frank Gomes and
Betty Doi Gomes: TaX Map Key No. (3) 7-5-018:009.
Prank Gomes and Betty Doi Gomes are the owners of real property in Wai`aha I ", North Kona, Hawaii,
specifically Tas Map Key No. (3) 7-5-018:009, consisting of approximately 0.07 acre, more or less. They have
graciously donated this property to clear title to the County of Hawaii as an addition to the Ali`i Drive
right-of-ti~ay.
Pursuant to Article XIII, Section 13-12, Hawaii County Charter, the Council, on behalf of the County, may
accept gigs or donations of real property.
Originally heard nn February 18, 2004, this measure was deferred at the request of the Office of the Corporation
Counsel.
Resolution No. 150-04, Draft 2 was referred to Your Committee, dated February 26, 2004, from
Deputy Corporation Counsel Patrick K. O'Toole, which clarifies Ali`i Drive's right-of--way.
I leard on March 16, ?004, this measure was deferred pending inclusion of a metes and bounds description, a copy
of the decd and an amendment to Resolution No. 150-04, to reference the added deed.
Resolution No. 150-04. Draft 3 was referred to Your Committee, dated May 19, ?004, from
Deputy Corporation Counsel Patrick K. O'Toole, which included the deed from Frank Gomes and Beny Gotnes.
together with the metes and bounds description.
A letter of appreciation will be sent to Frank Gomes and Betty Doi Gomes, 3063 Kahaloa Drive, Honolulu,
Hawaii 96833, acknowledging this generous donation.
Your Commmittee on Finance is in accord with the purpose and intent of Resolution No. 150-04, Draft 2, as
amended to Drafi 3, and recommends its adoption.
