Yow~ Committee on Planning, to which was referred Communication No. 667 and Bill No. 283,
transmitted by Mayor Marry Kim, dated ,tune 21, 2004, regarding a State Land Use Boundary
Amendment application by Nedra Roberts, at Ouli, South Kohala, Hawaii, TMK: 6-2-1 1:10,
reports as billows:
Bill No. 283 seeks to change the State Land Use Boundaries Map. H-14, by changing the District
Classification for approximately 5.832 acres of land from the Agricultural to the Rural District.
Communication No. 667 reports the Iiawai'i County Planning Commission, as required by the
I Iawai'i County Charter, Chapter 4, Section 6-4.3(c), considered the above request and
accompanying Bill No. 284 on May 28, 2004. At this meeting, the Commission concurred with
the Planning Director's favorable recommendation for approval of this matter. Commwrication
No. 667, in synopsis, also reports the Planning Director's findings and recommendations as the
following:
fhe applicant, Nedra Roberts. is reyuesting a State Land Use Boundary Amendment from
Agricultural to Rural for approximately 5.832 acres of land identified as TMK: 6-2-1 1:10.
The applicant is the owner of the property. Exhibit A further delineates the parcel.
fhe property was created in 1990 as one of the original 36 lots of the Anekona Estates
Subdivision. "fhe property is located on the north side of Kanehoa Street, at the Anekona
Street-Kanehoa Street intersection.
There is asingle-family dwelling on part of the lot. The balance of the site is vacant and
unused. The site has been graded.
4. 'T'he applicant intends to subdivide the property into two lots of approximately two acres
in sire.
5. All utilities and services are available to the property.
6. The approval of the State land Use Boundary Amendment from Agricultural to the Rural
District will not be violative of Chapter 205, Hawaii Revised Statutes, nor will it be
inconsistent with the Land Use Commission Rules or TTawai'i State Plan or the Hawaii
County General Plan based on the following:

• The subject property is not within the Special Management Area.
• State law enables Counties to approve amendments to State District Classifications
for parcels under 15 acres in size. The subject property for this re-districting request
is 5.832 acres in size.
Land Use Commission Rules for applying the Rural District Boundary include:
parcels of land with no more than one single family dwelling per one-half acre and
low density residential lot areas where "city-like" concentrations of people and
structures are absent. The subject area meets the Commission's Rural District
standards.
Che reclassification action is consistent with the Housing goals, objectives and/or
policies articulated in the Hawaii County General Plan and the Hawaii State Plan
by developing additional housing opportunities for residents.
At today's meeting, Greg Mooers, representative of the applicant provided this Committee with
background information about the origins and purpose of Bill No. 283.
lluring discussion, members of this Committee inquired about the traffic levels in the area and
also about the possibility of rezoning the entire subdivision.
Your Committee concurs with the Planning Commission and the Planning Director's favorable
recommendation for approval of this District reclassification request.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 283 and
recommends it pass tirst reading.
