Hawaii 96720 Your Committee on Planning, to which was referred Communication No. 667 and Bill No. 284, transmitted by Mayor Harry Kim, dated June 21, 2004, regarding a Change of 7.one request application by Nedra Roberts, at Ouli, South Kohala, Hawaii, TMK: 6-2-I 1:10. reports as follows: E3ill No. 284 seeks to amend Section 25-8-7 (North & South Kohala District Zone Map), Article 8, Chapter 25 (Zoning Code) of the Hawaii County Code, by changing the District Classification for approximately 5.832 acres of land from Agricultural (A-Sa) to Residential and Agricultural (RA-2a). Communication No. 667 reports the Hawaii County Planning Commission, as required by the Hawaii County Charter, C hapter 4, Section 6-4.3(c), considered the above request and accompanying F3ill No. 283 on May 28, 2004. At this meeting, the Commission concurred with the Planning Director's favorable recommendation for approval of this matter. Communication No. 667, in synopsis, also reports the Planning Director's findings and recommendations as the following: I. '1"he applicant, Nedra Roberts, is requesting a Change of Zone for approximately 5.832 acres of land identitied as'I~MK: 6-2-I I:10, from Agricultural (A-Sa) to Residential and Agricultural (RA-2a). The applicant is the owner of the property. Exhibit A further delineates the parcel. 2. The property was created in 1990 as one of the original 36 lots of the Anekona Estates Subdivision. The property is located on the north side of Kanehoa Street, at the Anekona Street-Kanehoa Street intersection. 3. There is asingle-family dwelling on part of the lot. The balance of the site is vacant and unused. The site has been graded. 4. The applicant intends to subdivide the property into two lots of approximately two acres in size. 5. Acccss to the site is proposed from Kanehoa Street, a private roadway with a 50-toot right-of-way with 16 feet of asphalt paving and grass swales. 6. All utilities and services are available to the property. 7. 'Che approval of the Change of Zone request from Agricultural (A-Sa) to Residential and Agricultural (RA-2a) zoned district would result in an appropriate land use pattern that will further benefit the public based on the following: An amendment to the State Land Use Boundaries Map from an Agricultural to Rural District (Bill No. 283) is being concurrently processed for the proposed parcel subdivision. Upon the adoption of this amendment, the proposed Change of Zone request will be consistent with the proposed Rural District Designation. PC P~eport Pdo. 95 Communication 667 Bill 284 Page 2 • The rezoning action complements the Housing goals, objectives and/or policies articulated in the Hawaii County General Plan by providing additional housing options. • The General Plan LUPAG Map designation for the area is Extensive Agriculture. Current land uses in the area are residential and agricultural uses. The proposed use is consistent with the existing uses already established for this area. Surrounding properties have been reclassified into the Rural District and rezoned to Residential-Agricultural (RA-2a). • The project site is unclassified by the State of Hawaii ALISH Map. 'fhe Land Use Study Bureau's Overall Master Productivity Rating for the soils in the area is "E" or "very poor". The subject property is not actively used for agricultural purposes. • The approval of the Change of Zone Request will not be violative of Chapter 205A, Hawai' i Revised Statutes. The property is not situated within the Special Management Area. It is located approximately six miles away from the coastline. • The Flood Insurance Rate Map (FIRM) identifies the parcel as outside the 500-year flood plain. • No archeological sites, cultural or historical resources are expected to be adversely affected as a result of this request. 8. Requisite of the Planning Director's favorable recommendation for the Change of Zone request are approximately eleven conditions contained in Bill No. 284 that outline specific requirements for the proposed project. At today's meeting, Greg Mooers, representative of the applicant, provided this Committee with background information about the origins and purpose of Bill No. 284. Your Committee concurs with the Planning Commission and the Planning Director's favorable reairnmendation for approval of this rezoning request. Your Committee on Planning is in accord with the intent and purpose of Bill No. 284 and recommends it pass first reading.
