Your Committee on Planning, to which was referred Communication No. 668 and Bill No. 285,
transmitted by Mayor Harry Kim, dated June 2l, 2004, regarding a State Land Use Boundary
Amendment application by Gary and Betsy Queen, at Ouli, South Kohala, Hawaii. TMK: 6-2-
11:16, reports as follows:
Bill No. 285 seeks to change the State Land Use Boundaries Map, H-14, by changing the District
Classitication for approximately 5.002 acres of land from the Agricultural to the Rural District.
Communication No. 668 reports the Hawaii County Planning Commission, as required by the
I Iawai'i County Charter, Chapter 4, Section 6-4.3(c), considered the above request and
accompanying Bill No. 286 on May 28, 2004. At this meeting, the Commission concurred with
the Planning Director's favorable recommendation for approval of this matter. Communication
No. 668, in synopsis, also reports the Planning Director's findings and recommendations as the
following:
The applicants, Gary and Betsy Queen, are requesting a State Land lJse Boundary
Amendment from Agricultural to Rural for approximately 5.002 acres of land identified
as TMK: 6-2-1 l :l 6. The applicants are the owners of the property. Exhibit A further
delineates the parcel.
I'hc property was created in 1990 as one of the original 36 lots of the Anekona Estates
Subdivision. The property is located on the north side of Kanehoa Street, at the Anekona
Street-Kanehoa Street intersection.
There is asingle-family dwelling on part of the lot. The balance of the site is vacant and
unused.
4. The applicant intends to subdivide the property into two lots of approximately two acres
in sire.
5. The property is a two-unit Condominium Property Regime (CPR).
6. All utilities and services are available to the property.

Rural District will not be violative of Chapter 205, Hawaii Revised Statutes,
complements [.and Use Commission Rules and is supportive of the Hawaii State Plan
and the Hawaii County General Plan based on the following:
• 'I~hc subject property is not within the Special Management Area.
[,and Use Commission Rules for applying the Rural District Boundary include:
parcels of land with no more than one single family dwelling per one-half acre and
low density residential lot areas where "city-like" concentrations of people and
structures are absent. The subject area meets the Commission's Rural District
standards.
The reclassification action is consistent with the Housing goals, objectives and/or
policies articulated in the Hawaii County General Plan and the Hawaii State Plan by
developing additional housing opportunities for residents.
At today's meeting. Chris Yuen, Planning Director, and Greg Mooers, representative of the
applicant, provided this Committee with background information about the origins and purpose
of Bill No. 285.
Your Committee concurs with the Planning Commission and the Alarming Director's favorable
recommendation for approval of this District reclassification request.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 285 and
recommends it pass tirst reading.
