No. 668/Bill No. 286 PLACE: Councilroom 1'IMG 1:25p.m. Chair and Members Hawaii County Cowuil Hilo- Hawaii 96720 Your Committee on Planning, to which was referred Communication No. 668 and Bill No. 286, transmitted by Mayor Harry Kim, dated June 21, 2004, regarding a Change of Zone request application by Gary & Betsy Queen. at Ouli, South Kohala. Hawaii, TMK: 6-2- I L 16. reports as follows: Bill No. 286 seeks to amend Section 25-8-7 (North & South Kohala District Zone Map), Article 8, Chapter 25 (zoning Code) of the Hawaii County Code, by changing the District Classification for approximately 5.002 acres of land from Agricultural (A-Sa) to Residential and Agricultural (RA-2a). Communication No. 668 reports the Hawaii County Planning Commission, as required by the Hawaii County Charter, Chapter 4, Section 6-43(c), considered the above request and accompanying Bill No. 285 on May 28, 2004. At this meeting, the Commission concurred with the Planning Director's favorable recommendation for approval of this mattes Communication No. 668, in synopsis, also reports the Planning Director's findings and recommendations as the following: I . ~[~he applicants, Gary & Betsy Queen, are requesting a Change of 7.one for approximately 5.002 acres of land identified as TMK: 6-2-1 1:16, from Agricultural (A-Sa) to Residential and Agricultural (RA- 2a). The applicants are the owner of the property. Exhibit A further delineates the parcel. 2. The property was created in 1990 as one of the original 36 lots of the Anekona Estates Subdivision. The property is located on the north side of Kanehoa Street, at the Anekona Street-Kanehoa Street intersection. 3. There is asingle-family dwelling on part of the lot The balance of the site is vacant and unused. Another single family dwelling will be constructed after the property is subdivided. 4. The applicant intends to subdivide the property into two lots of approximately two acres in size. 'fhe property is a two-unit Condominium Property Regime (CPR), which will be voided upon final subdivision. 5. Access to the site is proposed from Kanehoa Street, a private Roadway with a 50-foot righEOt:way with 16 feet of asphalt paving and grass swales. 6. All utilities and services are available to the property. 7. The approval of the Change of Zone request from Agricultural (A-Sa) to Residential and Agricultural (RA-2a) zoned district would result in an appropriate land use pattern that will further benefit the public based nn the following: An amendment to the State Land Use Boundaries Map from an Agricultural to Rural District (Bill Nu. 285) is being concurrently processed for the proposed parcel subdivision. Upon the adoption of this amendment, the proposed Change of Zone request will be consistent with the proposed Rural District Designation. PC Report No. 97 Communication 668 Bill 286 Page 2 • The rezoning action complements the Rousing goals, objectives and/or policies articulated in the I lawai'i County General Plan by providing additional rural style residential housing options. • 'I~hc General Plan LUPAG Map designation for the area is Extensive Agriculture. Current land uses in the area arc residential and agricultural uses. The proposed use is consistent with the existing uses already established for this area. Surrounding properties have been reclassified into the Rural District and rezoned to Residential-Agricultural (RA ?a). • The project site is unclassified by the State of Hawaii ALISH Map. The Land Use Study Bureau's Overall Master Productivity Rating for the soils in the area is "E" or "very poor". The suhject property is not actively used for agricultural purposes. • The approval of the Change of Zone Request will not be violative of Chapter 205A, Hawaii Revised Statutes. The property is not situated within the Special Management Area. It is located approximately six miles away from the coastline. • 'I~he Flood Insurance Rate Map (FIRM) identifies the parcel as outside the 500-year flood plain. • No archeological sites, cultural or historical resources are expected to be adversely affected as a result of this request. 8. Requisite of the Planning Director's favorable recommendation for the Change of Zone request are approximately eleven conditions contained in Bill No. 286 that outline specific requirements for the proposed project. At today's meeting, Chris Yuen, Director. Planning Department, and Greg Mooers, representative of the applicant, provided this Committee with background information about the origins and purpose of Bill No. 286. Your Committee concurs with the Planning Commission and the Planning Director's favorable reconunendation for approval of this rezoning request. Your Committee on Planning is in accord with the intent and purpose of Bill No. 286 and recommends it pass first reading.
