Your Committee on Planning, to which was referred Communication No. 686 and Bill No. 294,
transmitted by Mayor Harry Kim, dated June 28, 2004, regarding a Change of Zone request application
by Gerald Yamada, at Waiakea, South Hilo, Hawaii, TMK: 2-4-38:8 reports as follows:
Bill No. 294 seeks to amend Section 25-8-33 (City of Hilo Zone Map), Article 8, Chapter 25 (Zoning
Code) of the Hawaii County Code, by changing the District Classification for approximately 4.335 acres
of land from Agricultural (A-3a) to Single-Family Residential (RS-10).
Communication No. 686 reports the Hawaii County Planning Commission, as required by the Hawaii
County Charter, Chapter 4, Section 6-43(C), considered the above request on June 4, 2004. At this
meeting, [he Commission concurred with the Planning Director's favorable recommendation for your
approval of this matter. Communication No. 686, in synopsis, also reports the Planning Director's
findings and recommendations as the following:
I . The applicant, Gerald Yamada, is requesting a Change of Zone for approximately 4335 acres of land
identified as TMK: 2-4-38:8, from Agricultural (A-3a) to Single-Family Residential (RS-10). The
applicant is the owner of the property. Exhibit A further delineates the parcel.
2. The property is located on the south side of Haihai Street, across from Hanohano Street, in Waiakea
Homesteads 2id Series.
3 . The applicant intends to subdivide the property into nine lots between 15,000 and 20,000 square feet
each. The estimated cost of the project is $500,000. The applicant also intends to build homes on
four of [he proposed lots.
4. Access to the site for six of the lots is proposed from Haihai Street and a private roadway with a
pavement width of 16-feet. The remaining three lots will have access from Paulele Street and over a
private road with a pavement width of 14-16 feet.
5. All utilities and services are available to the property.
6. The approval of the Change of Zone request from Agricultural (A-3a) to Single-Family Residential
(RS-10) zoned district would result in an appropriate land use pattern that will further benefit the
public based on the following:
• l'he General Plan LUPAG Map designation for the area is Low Density Urban. Current land uses
in the area are primarily residential. The proposed use is consistent with the existing uses already
established for this area. Surrounding properties are classified Agriculture, Family-Agriculture
and Single-Family Residential.

• The State of Hawaii ALISH Map and the Land Use Study Bureau's Overall Soil Rating identify
the area as Urban. The subject property is vacant and is not currently used for agriculture.
• The approval of the Change of Zone Request will not be violative of Chapter 205A, Hawaii
Revised Statutes. The property is not situated within the Special Management Area. It is located
approximately four miles away from the coastline.
• The Flood Insurance Rate Map (FIRM) identifies a majority of the parcel as outside the 500-year
flood plain. A roadway on the project site is identified as being within the "AE", Special Flood
Hazard area. Any construction within this area will conform to Chapter 27, Flood Control, of the
Hawaii County Code.
• No archeological sites, cultural or historical resources are expected to be adversely affected as a
result of this request.
7. Requisite of the Planning Director's favorable recommendation for the Change of Zone request are
approximately twenty-two conditions contained in Bill No. 294 that outline specific requirements for
the proposed project.
At today's meeting, Sidney Fuke, representative of the applicant, provided this Committee with
background information about the origins and purpose of Bill No. 294. Mc Fuke explained that the
applicant would construct homes on four of the nine lot subdivision and that the roadway and
drainage areas would be privately owned and maintained.
On behalf of the applicant, Mc Fuke also requested that Condition F, which requires that access to the
site be aligned to Hanohano Street, be amended, particularly the language that required alignment
with Hanohano Street. He said that the applicant desires, in conjunction with the Department of
Public Works, to investigate all possible access and alignment possibilities. Mr. Fuke explained that
passing the bill with Condition F as proposed would mandate the Hanohano alternative and prevent
the exploration of alternative routes.
During discussion, members of this Committee attempted unsuccessfully to clarify the Department of
Public Works position on the proposed amendment to Condition F. It was requested that a
representative from the Department of Public Works comment on the item at the 1"reading. Other
members also inquired about flooding problems, the possibility of constructing alternate access routes
in different locations on the proposed project site, as well as the impact further lot subdivisions would
have on the size of the proposed right-of-way.
Post discussion, Your Committee voted to amend Bill 294, as follows
Condition F. The centerline of the private street servicing the proposed subdivision off Haihai
Street shall [ ]provide adequate sight distance, meeting with the
approval of the Department of Public Works. The private street shall provide access to no more
than six lots and shall terminate with a turnaround, meeting with the approval of the Department
of Public Works.

Your Committee concurs with the Planning Commission and the Planning Director's favorable
recommendation for approval of this rezoning request.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 294, as amended to
Draft Z, and recommends it pass first reading.
