Your Committee on Planning, to which was referred Communication No. 687 and Bill No. 295,
transmitted by Mayor Harry Kim, dated June 28, 2004, regarding an amendment to Change of
Zone Ordinance No. 93-62, requested by Hilo Storage Partners, at Waiakea, South Hilo,
Hawaii, TMK: 2-1-7:9 (1.028 acres) reports as follows:
Bill No. 295 seeks to amend Condition F of Change of Zone Ordinance 93-62, by deleting the
curb, gutter and sidewalk improvement requirement for Ocean View Drive.
Communication No. 687 reports that the Hawaii County Planning Commission, as required by
the Hawaii County Charter, Chapter 4, Section 6-4.3(C), considered this request on
June 4, 2004. The Commission concurred with the Planning Director's favorable
recommendation on this matter. Communication No. 687, in synopsis, reports the Planning
Director's findings and recommendations as the following:
The subject property totaling 1.028 acres is located at along the Makai side of
Kalanianaole Street adjacent to and east of the Orchid Manor Apartment complex.
Exhibit "A" further delineates the subject property.
2. Ordinance No. 93-62, effective on June 22, 1993, changed the district classification of the
subject property from Limited Industrial (ML-20) to General Industrial (MG-la).
The applicant requested the change of zone to consolidate TMK Nos. 2-1-7:9 and 10
in order to expand an existing fence constructing, manufacturing and retail business.
3. Condition F of Ordinance No. 93-62 mandated that curb, gutter and sidewalk
improvements were to be completed along the Kalanianaole Avenue and Ocean View
Drive before a certificate of occupancy was issued for the project.
^ The applicant concurs with the improvement requirements along Kalanianaole
Avenue to accommodate pedestrian and vehicular movement in this area.

^ The applicant believes that because Ocean View Drive is a paper road, which serves
as a parking lot for an adjacent apartment complex, and that no access to the project is
proposed from this area, the requirement to improve Ocean View Drive is not
feasible. As such he is requesting an amendment to Condition F of Ordinance 93-62.
4. Approval of this request would not be inconsistent with the original reasons for approving
the rezoning ordinance based on the following:
• The C,eneral Plan LUPAG Map designates the area for Industrial uses. The current
zoning of Limited industrial is consistent with this designation.
• All utilities and services are available to the site.
^ Agencies reviewing the request had no comments or concerns.
At today's meeting, Your Committee received testimony from Ocean View Drive residents
regarding the proposed legislation.
Your Committee concurs with the Planning Commission and the Planning Director's favorable
recommendation for approval of this request.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 295 and
recommends it pass first reading.
