No. 398/E3ill No. 177 <br />PI.ACI?: Council Chambers <br />"DIME: 10:05 a.m. <br />Crnmcil Chair and Members <br />Hawaii County Council <br />Hilo, Hawaii 96720 <br />Your Conumittce on Finance, to which was referred Bill No. 177, reports as follows: <br />Bill No. 177. U'ansmitted by Director of Finance William Takaba, via Communication No. 398, dated <br />Octoher 10. 2003, amends C hapter 19, I Iawai'i County Code 1983 (1995 Edition), Real Property Taxes, <br />relating to home exemptions. <br />1'he purpose of this measure is to improve the definition of real property owned and occupied as a <br />principal home as defined in subsectirn~ 19-71(e). The proposal has three elements necessary for real <br />propertq to he considered a principal home and some of the documentation dial the director of finance <br />may- require as evidence of the owner's intent to create or maintain a principal home. <br />Originall~~ heard on November 4.2003, this measure was deterred. <br />At subsequent Finance Committee workshops held on November 3 & 17, 2003, Director of Finance <br />William ~fakaba explained that the definition now for "principal home" is a place where an individual has <br />a truo_ tixcd, permanent home and principal establishment and to which place the individual has, <br />rahencvcr absent the intention of returning. It is the place in which an individual has voluntarily fixed <br />hahitation, not for mere special, teimporary, or vacation purpose, but with the intention of making a <br />permanent home. This proposal will spell out what the administration will look for in a principal home, <br />and also ~tihat it takes Io quality for a principal home. <br />Your Committee recommends Bill No. 177 he filed and the amendments be included with Bill No. 174 as <br />a new bill.
