HomeMy WebLinkAboutREP PC 111 10/05/2004 2002-2004REPORT OF THE COMMITTEE ON PLANNING DATE: October 5, 2004 RE: Communication No. 564 PLACE: Councilroom TIME: 1:35 p.m. Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Communication No. 564, reports as follows: Communication No. 564, dated March 22, 2004, is from Mayor Harry Kim submitting the appointment of Mr. Riley Saito, to serve on the Kailua Village Design Commission. According to Communication No. 564, Mr. Saito is a 42-year resident of Hawaii and is the Vice President of Mauna Lani Bay Hotel and Bungalows. He will fill the slot representing local businesses and property owners. Mr. Saito is not affiliated with any political party. If confirmed, he will serve until December 31, 2006. Your Committee first considered this matter on Apri120, 2004. At that meeting, Your Committee deferred action on Mr. Saito's nomination pending a legal opinion From the Office of the Corporation Counsel clarifying his appropriateness to serve in light of residency requirements of the commission as defined in the Hawaii County Code. The Hawaii County Code, Chapter 25, Section 25-7-2, relating to Zoning and the Kailua Village Design Commission delineates the membership requirements of the Kailua Design Commission as the following: (a) The design commission shall consist of nine members who shall be appointed by the mayor with the approval of the council. (b) The members shall be representative of the Kona district, provided that a majority of the appointive members shall have lived or worked in the Kailua Village for a minimum of two years prior to this appointment. (c) The design commission members shall include two design professionals (registered architects and/or landscape architects), two members with backgrounds in building construction and/or engineering, two members with knowledge about historic Kona, its cultural values and resources, and the remaining three members representing local business or property owners. Communication No. 564 October 5, 2004 Page 2 An opinion confirming that Mr. Saito could serve on the commission was received on September 15, 2004, from the Mayor's Office and numbered as Communication 564.1. At today's meeting, Mr. Wendell Hatada, Executive Assistant, Office of the Mayor, answered committee questions regarding the nomination. Your Committee on Planning recommends the approval of the appointment of Mr. Riley Saito to the Hawaii County Kailua Village Design Commission for a term ending December 31, 2006.
