HomeMy WebLinkAboutREP PC 114 10/19/2004 2002-2004REPORT OF THE COMMITTEE ON PLANNING DATE: October ] 9, 2004 RE: Communication No. 788/Bill No. 342 PLACE: Councilroom TIME: 9:08 a.m. Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Communication No. 788 and Bill No. 342, transmitted by Mayor Harry Kim, dated September 22, 2004, regarding a State Land Use Boundary Amendment application by Lillian Mahi, at Kalaoa 1 s' and 2"d, North Kona, Hawaii, TMK: 7-3-11:68, reports as follows: Bill No. 342 seeks to change the State Land Use District Boundaries Map, H-7, by changing the District Classification for approximately 1.8629 acres of land from the Agricultural to Urban District. Communication No. 788 reports the Hawaii County Planning Commission, as required by the Hawaii County Charter, Chapter 4, Section 6-4.3(C), considered the above request and accompanying Bill No. 343 on September 3, 2004. T'he Commission concurred with the Planning Director's favorable recommendation on this matter. Communication No. 788, in synopsis, reports the Planning Director's findings and recommendations as the following: I . The applicant, Lillian Mahi, is the co-owner of the property. The applicant is requesting a State Land Use Boundary Amendment for 1.8629 acres from the Agricultural District to the Urban District. 2. The subject property is located on the southwest corner of the Mahilani Drive-Mamalahoa Highway intersection in Kalaoa 1st and 2nd, North Kona, Hawaii. 3. The applicant is also requesting a concurrent Change of Zone (Bill 343) from the Agricultural 5- Acre Co the Single-Family Residenital-20,000 square foot (RS-20) zoned district. 4. The applicant is requesting the State Land Use Boundary Amendment and the Change of Zone so that she may further subdivide the property into three separate parcels (two additional lots), which she intends to confer to each of her children. 5. The approval of the reclassification from the State Land Use Agricultural District to the Urban District will not be violative of Section 205-2, Chapter 205, Hawaii Revised Statutes, nor will it be inconsistent with the Land Use Commission Rules, and the Hawaii County General Plan based on the following: • A Change of Zone Request (Bill 343) is being concurrently processed with this request. • The subject property is situated in the immediate vicinity of the Kona Highlands Subdivision, which includes existing Urban-designated lands and uses. The request conforms with the Land Use Commission Rules, which encourages urban developments in close proximity to existing developments. Report No. 114 Communication 788 Bill 342 Page 2 • The request complements the Hawaii State Plan's goals and policies on Housing, which supports the setting of housing near existing communities that accommodates the needs and desires of fam i I ies. • The action also complements the Land Use and Housing elements of the General Plan by providing additional housing in an urban designated area. It is also consistent with the Kona Regional Plan, which identifies the area for residential development. • The property is not currently being used for active agricultural purposes. The property is "unclassified" on the State of Hawaii's Agricultural Lands of Importance to the State of Hawaii (ALISH) Map. The Land Use Study Bureau's Overall Master Productivity Rating for the soils in the area is "E" or "Very Poor". Therefore, the reclassification will not be detrimental to the agricultural land inventory in the County of Hawaii. • 'Fhe property has no severe geological or topographical problems which cannot be properly rectified or which would render the land unusable. • The Urban classification will not have a significant adverse impact to traditional, customary Hawaiian Rights or resources nor is it adjacent to the shoreline. At today's meeting, Planning Director Chris Yuen and Greg Mooers, representative for applicant, provided this committee with background information about the origins and purpose of Bill No. 342. The applicant, Lillian Mahi, was also present. Mr. Yuen explained that the application received a favorable recommendation from the Planning Department because the request coincides with established land use patterns in the area. Your Committee concurs with the Planning Commission and the Planning Director's favorable recommendation for approval of the State Land Boundary Amendment.
