Your Committee on Planning, to which was referred Communication No. 824 and Bill No. 359, transmitted
by Mayor Harry Kim, dated October 15, 2004, regarding a Change of Zone Request by Betty Wung, at
Waiakea Homesteads 2"d, South Hilo, Hawaii, TMK: 2-4-38:16 reports as follows:
Bill No. 359 seeks to amend Section 25-8-33 (City of Hilo), Article 8, Chapter 25 (Zoning Code) of the
Hawaii County Code, by changing the District Classification of approximately 2.51 I acres of land from
Family Agricultural 3-acres (A-3a) to Single Family Residential 15,000-square feet (RS-15).
Communication No. 824 reports the Hawaii County Planning Commission, as required by the Hawaii
County Charter, Chapter 4, Section 6-4.3(C), considered the above request on September 16, 2004. The
Commission concurred with the Planning Director's favorable recommendation on this matter.
Communication No. 824, in synopsis, reports the Planning Director's findings and recommendations as the
following:
I . The applicant, Betty Wung is requesting a Change of Zone amendment from Agricultural to
Residential for approximately 2.51 I acres of land. The applicant is the owner of the parcel.
2. The subject property is located on the south side corner of Haihai Street in Waiakea Homesteads 2"~
Series, South Hilo, Hawaii. There exists a single dwelling on the site. This dwelling is expected to
be demolished as part of this project.
4. The applicant intends to subdivide the property into a 6-lot subdivision, creating five additional lots
in the process. Each of the lots will be approximately 15,000-square feet in size. The applicant
intends to put the lots up for sale.
5. Access is proposed from Haihai Street unto a private roadway. The applicant will be required to
make various improvements to both accesses.
6. All utilities are or will be made available to the project site.
7. The approval of the Change ofI,one request from Family Agricultural 3-acre (A-3a) to the Single-
Family Residential 15,000-square foot (RS-15) zoned district would result in an appropriate land use
pattern that will further benefit the public based on the following:
• The request is supportive of the Land Use and Economic Element of [he Hawaii County General
Plan. The LUPAG designation for the area is Low Density Urban. Current land uses in the area
are a mix of residential uses. The proposed use is consistent with the urban form for this area.

• The subject property, while currently within the County Agricultural zoned districts, it is not
actively used for agricultural purposes. The project site is classified as "Existing Urban
Development" by the State of Hawaii ALISH Map. The Land Use Study Bureau's Overall
Master Productivity Rating is "Urban" as well.
• The approval of the Change of Zone Request will not be violative of Section 205-2, Chapter
205, Hawaii Revised Statutes. The property is not situated within the Special Management
Area. It is located approximately 4 miles from the coastline.
• As the site was originally developed some 50 years ago, there are no floral, fauna, nor
archaeological resources or historic sites that are expected to be adversely impacted by this
action.
• The subject parcel is in FIRM Zone "X" or outside the flood plain.
8. Requisite of the Planning Director's favorable recommendation for the Change of Zone request is
approximately twenty conditions contained in Bill No. 359 that outline specific access routes and
fair share requirements for the project.
At today's meeting, Planning Director Chris Yuen and Sidney Fuke, representative for the applicant,
provided this committee with background information about the origins and purpose of Bill No. 359. Mr.
Fuke also shared that only one person testified against the project at the commission level.
During discussion, Members questioned the appropriateness of utilizing a private roadway for the site.
Mr. Yuen explained that the Public Works Departments has included conditions aimed at improving the
roadway.
Post discussion your Committee voted to amend Bill 359 with the following:

Your Committee concurs with the Planning Commission and the Planning Director's favorable
recommendation for approval of the Change of Zone request.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 359, as amended to Draft
2, and recommends it pass first reading.
