HomeMy WebLinkAboutREP PC 121 11/09/2004 2002-2004REPORT OF THE COMMITTEE ON PLANNING DATE: November 9, 20004 RE: Communication 825/Bill No. 360 PLACE: Councilroom TIMF,: I:00 p.m. Chair and Members Hawaii County Council Kilo, Hawaii 96720 Your Committee on Planning, to which was referred Communication No. 825 and Bill No. 360, transmitted by Mayor Harry Kim, dated October 15, 2004, regarding a Change of Zone request application by Glenn Ahuna, at Waiakea, South Hilo, TMK: 2-2-21:30 reports as follows: Bill No. 360 seeks to amend Section 25-8-33 (City of Hilo Zone Map), Article 8, Chapter 25 (Zoning Code), Hawaii County Code by changing the District Classification from Single Family Residential ] 0,000-square feet (RS-10) to Residential-Commercial Mixed Use 10,000-squaze feet (RCX-10) for approximately 9,367 square feet. Communication No. 825 reports the Hawaii County Planning Commission, as required by the Hawaii County Charter, Chapter 4, Section 6-4.3(C), considered the above request on September 16, 2004. At this meeting, the Commission concurred with the Planning Director's favorable recommendation for your approval of this matter. Communication No. 825, in synopsis, also reports the Planning Director's findings and recommendations as the following: The applicant, Glenn Ahuna, is requesting a Change ofLone from Single Family Residential 10,000-square feet (RS-] 0) to Residential-Commercial Mixed Use ] 0,000- square feet (RCX-l0) for approximately 9,367 square feet. The applicant is the owner of property. The property is located along the south side of Mohouli Street. There exists a dwelling on the site. Map Exhibit "A" further delineates the subject parcel. The applicant is requesting the Change of Zone in order to convert the existing dwelling into a business, with four stalls. Specifically, an Engineering Consultant Services office. The applicant also reports that there is the possibility that a new structure may be constructed on the site in the future. Total improvements to the site are estimated at $25,000.00 4. Access to the site is proposed through the existing Mohouli Street access. The applicant intends to make necessary improvements along the portion of the roadway, which fronts this property. 5. All essential utilities are or will be made available to the site as part of this project. Report No. 121 Communication 825 Bi11360 Page 2 6. The approval of the Change of Zone request from Single Family Residential 10,000-square feet (RS-]0) to Residential-Commercial Mixed Use 10,000-square feet (RCX-10) would result in an appropriate land use pattern that will further benefit the public based on the following: The rezoning action complements to the Land Use Element of the Hawaii County General Plan and the LUPAG Map designation for the area. The LUPAG Designation for the area is Medium Density Urban. Surrounding land uses are zones Residential and Commercial Mixed Uses. Because surrounding land uses, designations and zoning are compatible with the RCX zoning, this request is to be considered as conceptually consistent with the General Plan. • The County Zoning for the parcel is RS-10. The State Land Use Designation is also "Urban". The proposed use compliments both classifications. • The Land Use Study Bureau's Overall Master Productivity Rating for the parcel is "Urban". • The approval of the Change of Zone Request will not be violative of Chapter 205A, Hawaii Revised Statutes. The property is not situated within the Special Management Area. It is located approximately 1/2 miles away from the coastline. • As the site is already fully developed, no archeological sites, cultural, historical resources, nor species are expected to be adversely affected because of this request. • The Flood Insurance Rate Map (FIRM) identifies the parcel "X" outside the 500-year flood plain. 7. Requisite of the Planning Director's favorable recommendation for the Change of Zone request are approximately fourteen conditions contained in Bill No. 360 that delineate access routes and other requirements for the proposed project. At today's meeting, Chris Yuen, Director of the Planning Department and Sidney Fuke, representative of the applicant, provided this Committee with background information about the origins and purpose of Bill No. 360. During discussion, Mr. Yuen explained that the subject parcel is presently non-conforming and further clarified which commercial business uses are allowed in residential areas. Mr. Fuke clarified questions in relation to a drainage channel located on the parcel and explained the applicant's intent to open an engineering business on the site and future construction plans. Communication 825 Bill 360 Page 3 Mr. Tyler questioned the appropriateness and relevance of the Planning Department's use of proposed General Plan revisions as justification for approval of the request. Mr. Tyler exerted that proposed revisions were not yet policy. Post discussion, Your Committee voted to amend Bill 360 with the following: Condition F. Typographical error corrected (the). 2. Your Committee concurs with the Planning Commission and the Planning Director's favorable recommendation for approval of this Change of Zone request. Your Committee on Planning is in accord with the intent and purpose of Bill No. 360, as amended to Draft 2, and recommends it pass first reading.
