A RESOLUTION TO ENCOURAGE AN AFFIRMATIVE VOTE AT THE 2008
GENERAL ELECTION TO CONVENE A HAWAII STATE CONSTITUTIONAL
CONVENTION.
WHEREAS, the Constitution of the State of Hawaii (Constitution) was adopted by the
people of Hawaii at the election held on November 7, 1950, and further amended at subsequent
elections, and
WHEREAS, pursuant to article XVII, section 2, of the Constitution if any nine-year
period shall elapse during which the question for a Constitutional Convention shall not be
submitted by the Legislature, the lieutenant governor shall certify the question, to be voted on at
the first general election following that nine-year period; and
WHEREAS, as it has been ten years since the question to convene a Constitutional
Convention was last put to our voters, that question will be on the ballot at the 2008 general
election; and
WHEREAS, our last Constitutional Convention was convened in 1978; and
WHEREAS, the 1978 Constitutional Convention proposed constitutional amendments
on a number of issues of key importance to the citizens of the County of Hawaii including the
structure of county government and county authority regarding taxation, spending, and land use
regulation; and
WHEREAS, since 1978, the resident population of the County of Hawai'i has more than
doubled, and accordingly the issues facing the people of the County of Hawaii have increased in
volume and complexity; and
WHEREAS, our Constitution can only be modified by a majority vote of the electorate
on amendments proposed by the Hawaii State Legislature or a Constitutional Convention
consisting of'delegates elected by the voters; and
WHEREAS, many Hawaii County residents have voiced support for the convening of a
Constitutional Convention as a Constitutional Convention is the appropriate forum to discuss
crucial issues such as the operations of our State and County government and our common goals
for the preservation, protection, and enhancement of the State of Hawaii and its respective
counties; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that it
endorses an affirmative vote by the electorate at the 2008 general election to convene delegates
for a Constitutional Convention.
BE IT FURTHER RESOLVED, that, should the electorate approve the convening of a
Constitutional Convention, this Council urges the Hawaii State Legislature to enact legislation
during its 2009 regular session to fund the election of Convention delegates, convene and
complete a Constitutional Convention, and submit proposed amendments to the voters of
Hawaii for the 2010 general election.
