SUBJECT: RESOLUTION SUPPORTING THE NATIONAL ASSOCIATION OF COUNTIES' (NACo)
POSITION OPPOSING FEDERAL PREEMPTION OF LOCAL ZONING AUTHORITY OVER
SATELLITE BROADCAST AND CELLULAR PHONE ANTENNAS.
Attached for your consideration is a resolution in support of the National Association of Counties' Position
Opposing Federal Preemption Of Local Zoning Authority Over Satellite Broadcast And Cellular Phone Antennas.
Currently before the Federal Communications Commission and Congress is a proposal that would preempt local
zoning authority over the location of both satellite broadcast antennas and cellular phone towers. NACo has been in
opposition to this proposal and has taken a position recognizing that local governments are the closest to the people
and, accordingly, are more knowledgeable about and accountable for the consequences of land use decisions. NACo
further believes that local governments are also sophisticated enough to balance competing interests when making
their zoning decisions.
The purpose of this resolution is to express Ilawai'i County's opposition to Federal preemption of local zoning
authority over satellite broadcast and cellular phone antennas and to support NACo's position on this matter. This
matter is also being considered as a position of the Hawai'i State Association of Counties (HSAC).
