Comm. 891: APPOINTMENT TO WATER COMMISSION
From Mayor Dante K. Carpenter dated January 7, 1987,
submitting for confirmation, the following appointee to

Peter L. Hendricks, a republican from Kohala, for
a term to expire on December 31, 1991, to fill an

responding to the December 3, 1986 Council memo
regarding Mrs. Dorothea Carvalho's request regarding
fluoridation.
Transmits copy of a letter from Manuel C. W. Kau,
D.D.S., Chief, Dental Health Division, State Department
of Health, dated January 5, 1987, regarding their plans
to fluoridate the state's water systems.
Comm. 904: KAILUA VILLAGE SPECIAL DISTRICT AND URBAN DESIGN REVIEW
(Bill 310) COMMISSION
From Mayor Dante K. Carpenter dated January 9, 1987,
submitting for adoption, a bill to amend the
County Code in regards to the structure and
organization of the Kailua Village Special District and
Urban Design Review Commission.
Believes the amendments, which would shorten the name
of the Commission; reduce its membership from 14 to 9;
establish three-year staggered terms; and limit
reappointment, will improve the organization and
operation of the Commission.

Comm. 906: ROTATION OF HSAC ADMINISTRATION RESPONSIBILITIES
From Councilwoman Merle K. Lai, dated January 19, 1987,
regarding HSAC President Takashi Domingo's letter of
January 13, 1987, requesting that each County discuss
and take appropriate action on items regarding rotation
of administration responsibilities of the
HSAC Executive Committee.
Informs Kauai County Council is recommending that a
special committee be formed to study these problems,
and report its findings to the Executive Committee.
Comm. 908: COUNTY TORT LIABILITY, 1987 LEGISLATIVE SESSION
From Corporation Counsel Ronald Ibarra dated
January 14, 1987, recommending support of a bill, which
is part of the administration's legislative package for
the 1987 session, patterned after the State Tort
Liability Act, and would provide relief to the counties
similar to what the State Tort Liability Act provides
to the State.
Informs that, in light of the millions of dollars of
lawsuits filed against the County, this bill would
provide the County tremendous assistance in defense of
the taxpayers' dollars.
Comm. 910: AMENDMENT TO CONDITIONS J, L, M and N of
(Bill 311) CHANGE OF ZONE ORD. NO. 869
APPLICANT: HAWAIIAN KONA COAST ASSOCIATES

From Planning Commission Chairman Thomas Krieger dated
January 20, 1987, submitting for adoption, a bill to
amend Conditions J, L, M and N of Change of Zone
Ordinance No. 869, which rezoned approximately
72+ acres of land from an Unplanned (U) to
Multiple Residential (RM-4 and RM-7) and
Neighborhood Commercial (CN-10) zoned districts at
Kahului 2nd, North Kona.

for information, a report of the meeting of the
Committee held on January 16, 1987, in Honolulu.

Res. 252: ENTRANCE FEES - HAWAII VOLCANOES NATIONAL PARK AND

Urges the United States Congress to take necessary
steps to exempt Hawaii residents from the entrance fees
at the Hawaii Volcanoes National Park and
Pu'uhonua 0 Honaunau National Historical Park, which
are scheduled to begin on February 2, 1987.

Article 3, Chapter 25 (Zoning Code) of the

classification from Agricultural (A-5a) to
Agricultural (A-2a) at Kaawaloa, South Kona.

Comm. 893.1: From Planning Director Albert Lono Lyman dated
January 19, 1987, regarding the amendments made to
Bill 304. States the proposed conditions and

Comm. 893.1 restrictive covenants were developed in close
(cont'd) cooperation with the surrounding property owners and
that many of the specific provisions resulted from
their concerns. As such, he feels that the surrounding
property owners may not have had an opportunity to
review the amendments and should be given an
opportunity to do so. Suggests that the rezoning
request be remanded back to the Planning Commission or
that the applicant obtain notarized statements of
concurrence from surrounding property owners.
Also, informs of his concern of the deletion of the
phrase "(no horse farms)" from Section 2. C. (2) of
Bill 304. Suggests, in order to maintain the original
intent of the Planning Department and
Planning Commission, that the following clarifying
statement be added at the end of Section 2. B.:
"Although nothing contained herein shall prevent
the keeping of horses for personal use,
horsebreeding, in and of itself, shall not be
considered a substantial agricultural activity
for the purposes of complying with the
requirements of the subject condition."
Feels the other proposed amendments appear to be
consistent with the spirit and intent of the original
conditions.
