From Bob Williams dated October 25, 1987, thanking
members of the Planning Committee who insisted on
adequate and reasonable stipulations for beach access
and facilities as a condition for approval of the Kona
Village Resort's expansion plans; states future such
proposals should be treated with the same degree of
fairness and objectivity.
Comm. 1274.2: VIOLATION OF CHAPTER 92, HRS - THE SUNSHINE LAW
From Dorothy W. Doudna and Marge Mulhall,
Co-Presidents, League of Women Voters of Hawaii County,
dated October 8, 1987, informing of their concern on
the apparent violation of the "Sunshine Law" that took
place at the Planning Committee's August 10, 1987
meeting. States they cannot understand why the Council
Chairman was not requested to attend the meeting to
answer any questions members of the Committee had
regarding Resolution 335, and informs they support
Common Cause/Hawaii's request for an explanation of the
action and hopes that, in the future, the Council will
be more mindful of the intent and restrictions of the
"Sunshine Law".

States, in accordance with the requirements of
ordinance No. 439 and as amended by Ordinance Nos. 456,
475, 484, 538, 822, 854, 868, 878, 83-20, 84-40, 87-49,
87-52 and 87-68, the Commission voted to recommend the
approval of the requested amendments as outlined in the
transmitted Analysis In Support of the Petition
prepared by the Planning Department.
Also, transmits copies of the Final Environmental
Impact Statement which includes maps that designates
the subject property and a complete copy of the
Planning Commission transcript on the subject matter.
Comm. 1321: PETITION TO AMEND PLANNING COMMISSION RULE 12
Copy of letter to the Planning Commission from
Wayne Metcalf, Chairman, House Committee on Judiciary,
dated October 16, 1987, urging the Planning Commission
to amend Rule 12, relating to contested cases, to
conform to the State statutes as soon as possible so
that the public, governmental agencies and private
companies will be clear as to the rules under which
geothermal activities are to be permitted.
