PREPARATION NOTICE (EISPN)
From Glen M. Winter bottom, Punaluu Preservation
Committee, dated September 28, 1987, transmitting copy
of his article entitled "Punaluu committee's response",
which appeared in VIEWPOINT, rebutting the contention
in Communication 677.2 that Resort Master Plan
revisions will significantly reduce potential adverse
impacts on the Punaluu Special Management Area, and
offers comments on the revised EISPN.

requesting Council approval of a one-year time

Informs her client, Ahualoa Development, Inc., has
discovered problems, as listed, which have delayed
submission of the subdivision plans to the Planning
Department and anticipates being able to comply with
the other time requirements provided in the ordinance
if their request is granted.

church, regarding their concerns that: (1) the church
property not be used in any development format they are
not a party to or agrees to; (2) information be
confirmed and made available to all concerned on
development of Makalawena makai; (3) the extensive
grave sites in the area on the church's property be
dealt with in a proper and legal manner; and (4) an
agreement be reached between Bishop Estate and the
church after resolution of the above matters as to the
use or conveyance of the church's property and claims.

From Joe Freitas, a resident of Ka'u for over 50 years,
dated September 20, 1987, requesting that the Council
approve the 12 General Plan amendments proposed by
Glen Winterbottom and states that any kind of rocket
launching site in Ka'u would be dangerous to the people
of the Big Island and its fishing grounds.

Comm. 1274: VIOLATION OF CHAPTER 92, HRS - THE SUNSHINE LAW
From Larry Smith, Executive Director, Common
Cause/Hawaii, dated September 14, 1987, questioning the
manner in which Resolution 335, which amends Rule 4 of
the Rules of Procedure, was handled at the August 10,
1987 Planning Committee meeting.
States, according to reports, Planning Committee
Chairman Takashi Domingo called for a recess to discuss
the matter behind closed doors in Council Chairman
Stephen Yamashiro's office; thereafter, the rule change
was passed unanimously without explanation or public
discussion. Feels this appears to be a flagrant
violation of Chapter 92, HRS, and that the decision
made is invalid and should not be put into force by the
council.

Comm. 1275: REZONING REQUEST - NORPROP, INC.
(Bill 422) KAMAILI HOMESTEADS, PUNA

dated September 18, 1987, submitting a bill to change
the district classification for 48.77 acres of land
from an Agricultural 20-acre (A-20a) to an Agricultural

Comm. 1280: 1988 LEGISLATIVE PACKAGE - HAWAII CHAMBER OF COMMERCE

transmitting a listing of their 1988 legislative
package, which was approved by their Board of
Directors. Informs this submittal is being made to
apprise the Council of the business community's
concerns and hopes that serious consideration be given
to the issues when developing its agenda for the 1988
session.
Comm. 1283: APPOINTMENTS TO THE STATE PLAN POLICY COUNCIL
From Mayor Dante K. Carpenter ate Sep em er 25, 1987,
transmitting, in accordance with Section 226-53, Hawaii
Revised Statutes, as amended, the following three
individuals for possible appointment to the State Plan
Policy Council:
Mr. Keola Childs (William Keola Childs)
Executive Vice President of Maryl Development and
Part-time Manager of Development at Kealakekua
Ranch
Mr. Morris Y. Kimura
Realtor Associate with Kent Nakashima Realty and
a retired administrator/teacher with the State

Informs the list of possible appointees must be
forwarded to the Governor, along with documentation of
the Council's advice and consent, within 30 days of the
date of his letter; therefore, would appreciate being

C-1283: notified of the Council's action no later than Monday,
(cont'd) October 19, 1987.
The individual selected by the Governor will serve as
the West Hawaii representative until December 31, 1990,
filling a vacancy created by the expired term of
Mr. Ken Michael.
Comm. 1284: LEGISLATION FOR DEVELOPMENT AGREEMENTS
From Donna Mercado Kim, Chair, Zoning Committee, City
Council, dated September 28, 1987, informing, following
State passage of enabling legislation for development
agreements, they have been considering county-level
legislation to implement development agreements, and
transmits a copy of the following: (1) a videotape by
oceanic Cablevision of a facilitated workshop on
development agreements which was held on August 13,
1987; (2) the Workbook on Development Agreements, which
was furnished to all workshop participants; and (3) the
summary report of key ideas gathered at the meeting,
which was prepared by the the Conflict Management
Program of the Neighborhood Justice Center of Honolulu.
Comm. 1289: COMPLIANCE OF THE SUNSHINE LAW AND THE COUNTY CHARTER
From Chris Reed, President, Big Island Press Club,
dated October 1, 1987, informing they agree with the
concerns raised by Common Cause Hawaii in Comm. 1274
and requests that the Council take immediate steps to
ensure compliance with both the spirit and letter of
the Sunshine Law and the County Charter.
Believes the August 10, 1987 incident is but one in a
series of examples of what can most generously be
described as a casual attitude by the Council towards
compliance with state and county openness requirements,
despite repeated friendly warnings from the media.
Also, sites examples of events which they feel are in
clear violation of Chapter 92, HRS, and Section 13-20
of the Hawaii County Charter.

Informs the Commission, at its July 30, 1987 meeting
voted to forward a denial recommendation to the
Council. The Commission concurs with the findings of

HAWAIIAN RIVIERA RESORT

October 6, 1987, transmitting copies of the draft

C-1296: Environmental Impact Statement (EIS) for the proposed
(cont'd) Hawaiian Riviera Resort, which is being prepared in
conjunction with a General Plan amendment for
properties situated in Kahuku, Ka'u.
Informs any comments regarding the draft EIS should be
directed to Belt Collins and Associates before
November 6, 1987. Thereafter, a Final EIS will be
prepared.
