Brewer's proposed development at Punalu'u. Comm. 1296.2: COMMENTS ON FINAL E.I.S. - HAWAIIAN RIVIERA RESORT From Glen M. Winterbottom stating that, based on a thorough reading of the Final Environmental Impact Statement for the proposed Hawaiian Riviera Resort, he feels that the document does not meet the standards of acceptability set forth in Chapter 343, Hawaii Revised Statutes, and in Title 11, Department of Health, Chapter 200, Environmental Impact Statement Rules. Comm. 1480: SUMMARY OF SETBACKS IN THE AGRICULTURAL ZONED DISTRICT From Planning Director Albert Lono Lyman dated February 2, 1988, responding to the request for a summary of setbacks in the agricultural zoned district. Comm. 1483: KEALAKEHE PLANNED COMMUNITY FEASIBILITY STUDY From A. Scott Leithead, Administrator, Office of Housing and Community Development, dated February 3, 1988, transmitting for consideration, the first draft of the Kealakehe Planned Community Feasibility Study. Comm. 1491: RESOLUTION NO. 88-01 - PUNA COMMUNITY COUNCIL From Patricia A. Hess, Secretary, Puna Community Council, dated February 2, 1988, transmitting for information, a copy of Resolution No. 88-01, which was adopted by the Puna Community Council on January 26, 1988, regarding the development of electrical production facilities from the geothermal resources of the Puna district. From Planning Commission Chairman Thomas A. Krieger dated January 7, 1988, submitting a bill to change the district classification for 34,157 square feet of land from a Double Family Residential - 3,750 square foot (RD-3.75) to a Village Commercial - 10,000 square foot (CV-10) zoned district at Kailua-Kona, Waiaha 2nd, North Kona. Comm. 1445.1: From Gregg Kashiwa dated January 22, 1988, requesting, on behalf of his clients, Thomas Tibbles and William Babbitt, an amendment to the condition of their rezoning requiring curbs, gutters and sidewalks along Lunapule Road to doing the addition of three feet of paving instead. States elimination of sidewalk requirements would be appreciated and that his clients are willing to deed the setback area of approximately 2,500+ square feet to the County as a condition of rezoning thereby eliminating the condemnation procedure in the future. Comm. 1445.2: From Gregg Kashiwa dated January 25, 1988, transmitting a copy of a memorandum from Ron Nagata, AIA, to Planning and Public Works Departments, regarding the requirement of curbs, gutters and sidewalks on the condo project adjacent to the Tibbles/Babbitt property on Lunapule Road. Informs his clients remain willing to deed the land within the setback area to the County at no cost as well as match the improvements done to the roadway by Lunapule Kona Associates in the first increment of their development. Comm. 1445.3: From Planning Director Albert Lono Lyman dated February 1, 1988, informing he has requested the Department of Public Works to comment on Communication 1445.1. Comm. 1445.4: From Planning Committee Chairman Takashi Domingo dated February 16, 1988, transmitting copy of a memo to Planning Director from Chief Engineer dated February 5, 1988, commenting on Communication 1445.1, regarding the requirement of curbs, gutters and sidewalks along Lunapule Road. Krieger dated January 25, 1988, submitting a bill amending the General Plan Land Use Pattern Allocation Guide (LUPAG) Map and General Plan as originally adopted by Ordinance No. 439 and as amended by Ordinance Nos. 456, 475, 484, 538, 822, 878, 854, 868, 83-20, 84-40, 87-49, 87-52 and 87-68. Informs the Commission voted to recommend approval of the requested amendments as outlined in the Analysis In Support of the Petition prepared by the Planning Department. Also transmits copies of the Planning commission minutes and hearing transcripts on the subject matter. Comm. 1469.1: From Mae E. Mull, Island of Hawaii Representative, Hawaii Audubon Society, dated January 25, 1988, encouraging the retention of Makalawena in Conservation-Open land use and requesting the Planning Committee to encourage the State of Hawaii and Bishop Estate to pursue an agreement on a suitable land exchange in West Hawaii. Feels a resort at Makalawaena would be incompatible with a secure refuge for endangered Hawaiian waterbirds at 'Opae-'ula Pond and the fifty-plus adjacent smaller ponds. Comm. 1469.2: From Rhody L. Edwards, D.C., Malama Chiropractic Clinic, dated January 22, 1988, urging that Makalawaena be kept in Conservation zoning. Comm. 1469.3: From Zachary A. Smith, Associate Professor, Political Science, University of Hawaii at Hilo, dated January 26, 1988, informing of his support of a land trade with the State to prevent the resort development at Makalawena. Comm. 1469.4: From Council Chairman Stephen K. Yamashiro dated January 28, 1988, transmitting for disposition, letters supporting the preservation of Makalawena. Comm. 1469.5: From David A. Tarnas dated January 24, 1988, informing of his opposition to the proposed General Plan amendment for Makalawena. Comm. 1469.6: From Guido Giacometti, Director, Land Division, Kamehameha Schools/Bernice Pauahi Bishop Estate, dated PC-69 Page 4 February 22, 1988 C-1469.6: February 4, 1988, requesting deferral of their General (cont'd) Plan amendment request for Makalawena. Informs that since the Planning Commission recommended favorable consideration of their application at its January 12, 1988 meeting, they have continued to pursue and resolve several critical development issues which include the details of such things as public access, public parking, resource management plans, beach use, etc. States, with the cooperation of the Planning Director and State officials, these and other alternatives are being negotiated and they believe major refinements in these areas will unfold very shortly. Feels deferring the matter would permit them to crystalize these issues and present the Committee with solutions that will significantly resolve the needs and concerns of the community. Comm. 1469.7: From Arthur McCornack informing of his opposition to resort development at Makalawena; also, feels that the area could be established as a wilderness beach park and that a land exchange may be negotiated between Bishop Estate and the State. Comm. 1469.8: From Nancy Zufich dated February 2, 1988, informing of her opposition to resort development at Makalawena; also, transmits her comments on specific pages of the Project Summary for the proposed development. Comm. 1469.9: From Planning Committee Chairman Takashi Domingo dated February 4, 1988, transmitting for review, communications, newspaper clippings and other information relating to the General Plan amendment application for Makalawena, which were submitted by Mr. Terry Yuen. Comm. 1469.10: From Bill Graham, Life of the Land Big Island Representative, dated February 11, 1988, transmitting copies of correspondence between himself and Bishop Estate in an effort to effectuate a compromise between the Estate and those opposing development at Makalawena. Comm. 1028.2: Copy of letter to Guido Giacometti, Director, Land Division, Bishop Estate, from Bill Graham, Life of the Land Big Island representative, dated July 15, 1987, regarding their concerns on Bishop Estate's plans for Makalawena. Comm. 1028.3: Copy of letter to Kamehameha Schools/Bernice Pauahi Bishop Estate, from Mark Van Pernis of Gallup & PC-69 Page 5 February 22, 1988 Comm. 1028.3: Van Pernis, dated September 23, 1987, writing on (cont'd) behalf of the congregation and leadership of Mauna Ziona Church, formerly known as and the successor to Kekaha Church, regarding their concerns that: (1) the church property not be used in any development format they are not a party to or agrees to; (2) information be confirmed and made available to all concerned on development of Makalawena makai; (3) the extensive grave sites in the area on the church's property be dealt with in a proper and legal manner; and (4) an agreement be reached between Bishop Estate and the church after resolution of the above matters as to the use or conveyance of the church's property and claims. Comm. 1028.4: Copy of letter to Mayor Dante Carpenter from Dr. Jack R. Estes, dated October 15, 1987, informing of his opposition to plans for two huge hotels on Bishop Estate property at the Makalawena Beach site, and to the Awakee and Mahaiula Developments in the same area. Feels the County's rare and precious beach lands and access must be preserved for use by the public and future generations and that the crucial need for space, clean air and freedom of movement are imperative for a liveable Hawaii. Comm. 1028.5: Copy of letter to Planning Commission Chairman Thomas Krieger from Mike Luce, President, Kona-Kohala Chamber of Commerce, dated October 13, 1987, informing of their support of the Kamehameha Schools/Bishop Estate application for amendments to the General Plan to permit development of the proposed Makalawena Resort in North Kona, with conditions, as listed, which were considered at their September 23, 1987 quarterly meeting. Comm. 1028.6: From Guido Giacometti, Director, Land Division, Kamehameha Schools/Bernice Pauahi Bishop Estate, dated October 15, 1987, transmitting a version of a letter sent to various members of the public who have indicated an interest in Makalawena, and informs they are looking forward to working with various County offices for completion of the project. Comm. 1028.7: From Robert Sumner-Mack, M.D., dated October 16, 1987, urging the Council to take a long-term and cautious view of resort development at Makalawena and to keep the area zoned conservation.
