WAIKOLOA BEACH RESORT
Copy of letter to Ken Melrose, Director of Planning,
Waikoloa Beach Resort, from Planning Director Albert
Lono Lyman, dated October 27, 1988, acknowledging
receipt of the Annual Report for the Waikoloa Beach
Resort development, as required by Condition K of
Ordinance No. 85-75.
Informs that public access signs have not been
installed at the hotel site, as required by Condition
No. 3 of Special Management Area (SMA) Use Permit
No. 223, and requests immediate attention to the matter.

ANNUAL PROGRESS REPORT - MAUNA LANI RESORT DEVELOPMENT

Planner, Mauna Lani Resort, from Planning Director
Albert Lono Lyman dated October 26, 1988, acknowledging
receipt of the Annual Progress Report for the
Mauna Lani Resort development, as required by
Condition R of Ordinance No. 380.
States Condition H of the ordinance states that a
minimum of 53 acres shall be set aside for parks and
recreation purposes, of which, to date, only the
3.2-acre public park site has been provided. Informs
the areas referenced in their report relative to the
three historic preserves (32 acres) and the fishponds
(21 acres) cannot be credited to the park requirement;
therefore, additional park area will be required.

Comm. 1784.2: BILL 627 (DRAFT 4) - KONA BEACH DEVELOPMENT VENTURE

From Mayor Dante K. Carpenter a e November , 1988,
informing although he has signed Bill 627, Draft 4,
into law, he will administer the bill without reference
to the illegal provision in the housing conditions.
Instead, this condition will be administered, as
required by the Charter, by the appropriate executive
agency charged with the responsibility of approving the
method of satisfying the affordable housing requirement.
Comm. 1784.3: From David A. Tarnas, Big Island TORCH (The Ocean
Recreation Council of Hawaii), dated November 7, 1988,
transmitting a copy of their comments to the U.S. Army
Corps of Engineers and copy of a letter to
Governor John Waihee concerning the proposed marina for
Kohanaiki. They hope the marina will be disapproved
and that the State will offer to work with Kona Beach
Development Venture to expand upon Honokohau Harbor
instead.

Comm. 1844: AUTHORITY TO REQUIRE TRANSPORTATION AS PART OF
REZONING CONDITION
From Corporation Counsel John A. Wagner dated
October 21, 1988, rendering an opinion, as requested,
on whether or not a requirement for a developer to
provide transportation to and from work may be included
as a condition in an ordinance rezoning property.
States such a condition may be included if there is a
factual basis for including such a requirement and
there is a showing of a sufficient connection between
the situation caused by the development and the ability
of the requirement to alleviate that situation.
