Lai DATE: October 24, 1988 PLACE: Councilroom TIME: 1:30 p.m. CALL TO ORDER STATEMENTS Comm. 1110.10: NOISE POLLUTION From Michael Purcell, Citizens Seeking Fighting Cock Relief, dated September 26, 1988, outlining, for review and Council assistance, solutions to eliminate the noise pollution caused by the raising of game cocks in Hawaii County. Recommends formal request be made to the Department of Health to assist the County with a noise control ordinance. Comm. 1110.11: From Derrick W. Umemoto, President, Big Island Chapter, Hawaii Gamebreeders Association, dated October 6, 1988, commenting on Communication 1110.10. Pet. 19: A petition opposing the efforts of the Citizens Seeking Fighting Cock Relief, who are seeking the rezoning of agricultural lots to residential designation because they are subjected to noise made by fighting cocks. Comm. 1784.1: OPINION ON PUBLIC HEARING - KONA BEACH DEVELOPMENT VENTURE (KOHANAIKI) From Corporation Counsel John A. Wagner dated October 14, 1988, rendering an opinion as to whether or not the Council can hold a public hearing on Monday, October 17, 1988, to hear public statements concerning the Kohanaiki rezoning application. Concludes the hearing is permissible based on reasons, as listed. Comm. 1820: LAND USE RESEARCH FOUNDATION OF HAWAII - FINDINGS AND CONCLUSIONS ON LAND USE MATTERS BY INITIATIVE From R. Brian Tsujimura, President, and Dan Davidson, Executive Director, Land Use Research Foundation of Hawaii, dated October 17, 1988, submitting for review and use, their findings and conclusions on the issue of deciding land use matters by initiative. Comm. 556: CHARTER AMENDMENT - VACANCIES ON BOARDS AND (Bill 176) COMMISSIONS From Councilman Robert N. Herkes ate March 27, 1986, submitting an ordinance bill initiating a Charter amendment to establish procedures for filling vacancies on boards and commissions. Comm. 603.2: COMMENTS ON THE PROPOSED KONA REGIONAL PLAN Copy of letter to Planning Director Albert Lyman from Councilman Robert N. Herkes dated July 11, 1986, submitting proposals to revise the Kona Regional Plan. Res. 186-86: KONA REGIONAL PLAN Adopts the Kona Regional Plan as the official document to guide future developments in the Kona Region. President Takashi Domingo dated July 10, 1986, regarding H.S.A.C. communications. Comm. 703: AMENDMENT TO SUBDIVISION CODE, CHAPTER 23 PROPOSED BILL NO. 187 From H. William Sewake, Manager, Department of Water Supply, dated July 28, 1986, recommending that proposed Bill 187 to exempt subdivisions of land zoned Agriculture with a minimum lot size requirement of five acres or more from being provided with water in accordance with the Rules and Regulations of the Department of Water Supply be made specifically applicable only in areas where water systems do not exist. PC-85 Page 3 October 24, 1988 Comm. 792: PROPOSED BILLS TO AMEND THE STATE OHANA LAW From John P. Whalen, Director of Land Utilization, Department of Land Utilization, City and County of Honolulu, dated October 8, 1986, transmitting for the Council's support, copies of two proposed bills and a Justification Sheet to the State House of Representatives and the Senate which propose to amend the Hawaii Revised Statutes, County Zoning, Section 46-4(C), to allow each County the authority and discretion to implement the "Ghana" law according to their land use plans and housing needs. Also transmits a copy of a report entitled "Assessment of Ohana Zoning" which they submitted to the City Council. Included in this report is a proposed bill which has been before City Council since July 1985. Proponents of ohana housing have been very organized and effective in preventing passage of this bill. Comm. 910.2: ORDINANCE NO. 869 (FORMERLY HAWAIIAN KONA COAST ASSOCIATES) TMK: 7-5-19:1, 44 and 45 From Barney B. Menor, Real Estate Consultant to A1ii Kona Ventures, successor to Hawaiian Kona Coast Associates, dated November 14, 1987, requesting reconsideration of certain burdensome requirements contained in Ordinance 869, as amended, in order to facilitate development of early phases of their project to construct 73 single family homes in the mauka increment and multi-unit rental housing in the makai increment which do not have flooding problems and which are not immediately dependent on the completion of the AM Drive Realignment. Comm. 918: FIREWORKS BILL & FIREWORKS RELATED INCIDENTS From Fire Chief Francis E. Smith dated January 20, 1987, submitting copy of a fireworks bill which the Hawaii Fire Council will be submitting to the 1987 Legislature for consideration. The intent of the bill is to control fireworks on a statewide basis in line with the other 49 states. Also, submits the number and dollar losses of the State of Hawaii Fireworks Related Incidents. Comm. 918.1: From James W. Silver dated January 28, 1987, submitting a newspaper clipping from the Honolulu Advertiser dated January 27, 1987, regarding the Hawaii Fire Council's desire to have the Legislature enact a uniform statewide fireworks control law, and informs he is in support of the proposal. PC-85 Page 4 October 24, 1988 Comm. 1086: PERMITS FOR MOTOCROSS TRACK USE From Representative Andrew Levin dated April 23, 1987, transmitting a copy of an April 16, 1987 letter from the Kauai Planning Department, regarding permits for motocross track use, and suggests that Hawaii County regulate motocross tracks in the same way that Kauai County does so that there would be no need for State legislation. Comm. 1384: CONCERNS OF THE KONA PALISADES ESTATES COMMUNITY ASSOCIATION From Loyd Blomquist, Secretary, Kona Palisades Estates Community Association, dated November 10, 1987, transmitting copy of a letter from the Association to the Planning Department regarding traffic problems on Kai.minani Drive, the main thoroughfare serving Kona Palisades Subdivision, and the possibility that it will become worse due to proposed residential developments north of the subdivision. Requests the County withhold approval of any development in the area unless the developer or the County provides additional access roads between Mamalahoa Highway and Queen Kaahumanu Highway. Comm. 1384.1: Copy of letter to Loyd E. Blomquist, Secretary, Kona Palisades Estates Community Association, from Planning Director Albert Lono Lyman, dated November 23, 1987, acknowledging receipt of Communication 1384. Comm. 1504: REZONING REQUEST - ELIZABETH McCORMICK (Bills 500 KALOKO, NORTH KONA & 501) TMK: 7-3-24:35 (25.9 acres) From Planning Commission Chairman Thomas A. Krieger dated February 18, 1988, submitting a bill to change the district classification for 25.9 acres of land from an Agricultural 20-acre (A-20a) to an Agricultural 1-acre (A-la) zoned district at Kaloko, North Kona. Informs the Planning Director has recommended denial of the request and has proposed a change of the classification from an Agricultural 20-acre (A-20a) to an Agricultural 3-acre (A-3a) district; however, the Planning Commission has recommended approval of the rezoning request. Both legislative bills are being submitted for consideration. PC-85 Page 5 October 24, 1988 Bill 500: Amends Section 25-86 (North & South Kona Districts (Draft 2) Zone Map), Article 3, Chapter 25 (Zoning Code) of the Hawaii County Code, by changing the district classification from Agricultural (A-20a) to Agricultural (A-la) at Kaloko, North Kona. Bill 501: Amends Section 25-86 (North & South Kona Districts (Draft 2) Zone Map), Article 3, Chapter 25 (Zoning Code) of the Hawaii County Code, by changing the district classification from Agricultural (A-20a) to Agricultural (A-3a) at Kaloko, North Kona- Comm. 1504.22: From Francis McMahon dated July 26, 1988, urging support of Elizabeth McCormick's rezoning request because the property, on the makai side, is adjacent to land that is currently zoned one acre and based on his understanding that the applicant will limit the building of one house per lot with no ohana or second dwelling allowed and that there also will be setbacks and a buffer zone on the highway. Comm. 1504.23: From Peter L. Crackel dated July 22, 1988, stating his views on Elizabeth McCormick's rezoning application; further, suggests that an impact fee be assessed against the developer for infrastructure needs should the lots size be approved for one acre. Comm. 1504.24: From Jane Wilson dated August 3, 1988, informing of her support of Elizabeth McCormick's rezoning request. Comm. 1504.25: From Jean A. Jose pho-Hamilton dated August 15, 1988, informing of her support of Elizabeth McCormick's rezoning request. Comm. 1504.26: From Janice Baxter, M.S.W., dated August 25, 1988, informing of her support of Elizabeth McCormick's rezoning request because she feels the project will be a positive addition to the Kaloko area. PC-85 Page 6 October 24, 1988 Comm. 1530.1: REZONING REQUEST - OLAF LANGE KAHUA, NORTH KOHALA TMK: 5-9-06:7 (8.7 acres) Copy o memo to Fire Chief Francis E. Smith from Planning Director Albert Lono Lyman dated March 29, 1988, asking an early response to the Planning Committee's inquiry as to the basis of the Fire Department's recommendation that a 10,000-gallon holding tank for fire fighting purposes be provided for Olaf Lange's rezoning application as this provision was not recommended for similar rezoning requests within the Kohala Estates Subdivision. Comm. 1532: REZONING REQUEST - FLORA K. HAKE (Bill 514) KAAUHUHU HOMESTEADS, NORTH KOHALA TMK: 5-5-01:19 (7.63 acres) From Planning Commission Chairman Pro-Tem Gary Mizuno dated March 10, 1988, submitting a bill to change the district classification of 7.63 acres of land from an Agricultural (A-20a) to an Agricultural (A-la) zoned district at Kaauhuhu Homesteads, North Kohala. Informs both the Planning Commission and the Planning Director are recommending denial of the application. Pet. 3: REJECTION OF PROPOSED LOW ALTITUDE TACTICAL NAVIGATION (LATN) AREA OVER THE ISLAND OF HAWAII From Douglas G. Mason, dated August 21, 1985, submitting a petition requesting Mayor Carpenter and the Hawaii County Council to act on their behalf by rejecting the proposal of the U. S. Air Force to establish a low altitude tactical navigation (LATN) area over the Island of Hawaii so that military aircraft, including jet-powered tactical aircraft, based at Wheeler Air Force Base on Oahu can conduct high-speed, low-level training flights at altitudes between 100 and 1,500 feet over populated areas of the Island of Hawaii. Res. 208-86: AMENDMENTS TO THE HAWAIIAN HOMES COMMISSION ACT Urges the U. S. Senate to support House Joint Resolution 17, which adopts 53 amendments to the Hawaiian Homes Commission Act.
