ORDER OF RESOLUTIONS Res. 551-08: Authorizes the Payment of Funds of a Later Fiscal Year and of More Than One Fiscal Year for a Multi-Year Contract for a Waste-To-Energy Facility. {Authorizes the Mayor to enter into a multi-year contract for services of designing, building, and operating a Waste-To-Energy facility with a 20-year agreement, with one five-year option to extend contracted services (subject to a six-month review period for value engineering with an option to cancel by the County Council and a review after completion of the EIS and power purchase agreement with an option to cancel by the County Council).}; and FC-274; and Comm. 1062.42: From Environmental Management Director Bobby Jean Leithead-Todd, dated Apri130, 2008, requesting to make a presentation on Resolution 551-08. Res. 593-08: Fosters Effective Water Management Practices that Reduce Use of Electrical Energy and Potable Water Through Supply System Optimization. {Encourages the implementation of the recommendations in the Hawai`i County Energy Sustainability Plan by the Department of Water Supply in order to reduce the County's dependence on fossil fuels and save money by decreasing the total use of potable water and fossil fuel, and requests that the Mayor present a draft comprehensive water conservation policy to the Council by May 1, 2009.}; and FESG4. Res. 596-08 Requests the Department of Public Works to Immediately Begin Environmental (Draft 2): Assessments for Those Recommendations Requiring an Environmental Assessment and Implement Before September 1, 2008, Other Short-Term Recommendations Not Requiring an Environmental Assessment Relating to Infrastructure Improvements in Waimea, as Provided in the Final Report of the Parsons- Brinckerhoff Waimea Traffic Circulation Study (WTCS). {Calls upon the County to use the funds, totaling $9 million from the 2004 County bond issue, earmarked specifically for the implementation of recommendations made in the Parsons- Brinckerhoff WTCS.}; and PWIRG69. Hawai`i County Council-35 Page 3 May 7, 2008 Res. 605-08: Authorizes the Office of the Mayor to Enter Into an Agreement with the State of Hawai`i Department of the Attorney General, Pursuant to HRS 46-7, for the Evidence Specialist Pilot Program Grant for the Hawai`i County Police Department. {Funds would be used to fund two evidence specialist positions and also be used towards training, travel, uniforms, and equipment.}; and FG278. Res. 606-08: Creates a Legal Assistant II (Temporary) Position for the Office of the Prosecuting Attorney. {This position would coordinate law enforcement efforts by streamlining the flow of communication and information sharing between agencies such as the Police, Prosecutors, Public Defenders, private attorneys, Probation, the Courts, treatment providers, Department of Health, mental health providers, and other agencies.}; and FG280. Res. 607-08: Creates a Clerk III Position for the Department of Public Works. {This position would assist in establishing, researching, compiling, and maintaining bridge inspections; and the bridge scour inspections programs would enable the Department to comply with State and Federal mandates.}; and FG282. Res. 615-08: Authorizes the Department of Environmental Management to Replace Substandard Sewer Laterals in Experimental Affordable Housing Development, Queen Liliuokalani Village (QLV) Subdivision, Increments lA and 1B, Lots 1 Through 60, Keahuolu, North Kona, TMK Plats 7-4-011, 7-4-012 and 7-4-013. {The County is under an EPA mandate to close 29 County-owned gang cesspools that currently serve 183 properties in the QLV subdivision; therefore, this resolution addresses the closure ofthe QLV gang cesspools.}; and EMG14. Res. 616-08: Authorizes the Director of Finance to Enter Into Negotiations for the Acquisition of the Pa`o`o Ahupua`a Parcel in North Kohala, Pursuant to Chapter 2, Article 42, Hawai`i County Code 1983 (2005 Edition, as Amended). {Cited as a top priority by the Public Access, Open Space, and Natural Resources Preservation Commission and assigned a criteria score of 91% for acquisition purposes.}; and FG283. Res. 621-08: Determines the Real Property Tax Rates for the County of Hawai`i for the Fiscal Year July 1, 2008 to June 30, 2009. {Provides for the establishment of tax rates by the Council of the County of Hawai`i for net taxable building and net taxable land for each class of property (except affordable rental housing) established in accordance with Chapter 19, Article 7, Section 19-53(e) ofthe Hawai`i County Code. (The schedule of rates for the fiscal year ending June 30, 2009, to which the various classes of real property in the County of Hawai`i that is taxed per $1,000 of assessed valuation changed in the Residential and Agricultural categories from the previous year. Ford, dated April 9, 2008, transmitting proposed amendments to Bi11276, as listed in this Communication. Bi11279: Amends Ordinance No. 07-82, as Amended, the Operating Budget for the County of Hawai`i for the Fiscal Year Ending June 30, 2008. {Appropriates revenues in Federal Grants - Evidence Specialist Pilot Program ($100,892); appropriates same to Evidence Specialist Pilot Program.}; and FG279. Bi11281: Amends Ordinance No. 07-82, as Amended, the Operating Budget for the County of Hawai`i for the Fiscal Year Ending June 30, 2008. {Increases revenues in State Grants - Emergency Medical Services (EMS) ($106,438); appropriates same to Basic Emergency Medical Technician Training Other Current Expense. } {Additional funds would be used to meet current year expenses by the Fire Department who is contracted by the State Department of Health to provide emergency medical services on the Island of Hawai`i.}; and FG281. Bi11284: Adopts a Pay Plan for Persons Employed by the County Other Than Those Whose Pay is Otherwise Provided for, Designating Payroll Periods, Pay Days, Prescribing Requirements with Respect to Official Fidelity Bonds, and Repealing Ordinance No. 07-76 and All Amendments Thereto, Said Ordinance to be Known as the Salary Ordinance of 2008. {The significant amendments are: clarifies that the rates of compensation for the employees occupying positions covered by the Salary Ordinance are set by the pay grade assigned or by a fixed salary established by Section 7; provides the Council Chair with the authority to appoint employees and to authorize step movements; and includes the Engineering Student, SR-13, BU-03, class of work for the Department of Human Resources. }; and FG284. Hawai`i County Council-35 Page 7 May 7, 2008 Bi11285: Authorizes the Issuance of General Obligation Bonds of the County of Hawai`i for the Purpose of Funding All or a Portion of the Costs of Various Improvement Projects for the County; Fixing the Form, Denominations, and Certain Other Details of Such Bonds and Providing for the Sale Thereof; and Authorizes the Taking of Other Actions Relating to the Issuance and Sale ofthe Bonds. {Principal amount not to exceed $112,000,000, these funds would be used for a variety of capital improvement projects. The Finance Department's goal is to provide funds in a timely manner for prioritized projects as they develop and reach new contractual phases. Prioritization of projects are based on the following: addresses legal mandates, corrects major deficiencies or items critical for public safety and health, and addresses environmental concerns, operational efficiency and maintenance or improvement of existing assets. Currently, they have identified 47 projects that will be requiring funds to encumber in contracts within the next nine months. (If the County sells bonds in the amount of $112 million, the estimated percentage of debt service to total general expenditures will be less than 12.0%, assuming a 4.75% interest rate.)}; and FC-285. Bi11295: Amends Ordinance No. 07-83, as Amended, Relating to Public Improvements and Financing Thereof for the Fiscal Year July 1, 2007 to June 30, 2008. {Adds PUBLIC WORKS: Halawa Cemetery Road Repaving and Access Trails Improvement ($40,000); funds shall be provided from General Fund and/or Other Sources ($40,000). Resolution 568-08 approved by the Council on March 25, 2008, transferred contingency relief funds from District 9 to the General Fund's Transfer to the Capital Projects Fund Account. These funds would be used for a one-time paving of the Halawa Cemetery Road and improvement of the access trails. } Bi11296: Amends Ordinance No. 07-82, as Amended, the Operating Budget for the County of Hawai`i for the Fiscal Year Ending June 30, 2008. {Increases revenues in Transfer from General Fund ($27,920); appropriates same to Golf Course - Salaries and Wages (S&W). After recalculating the salary requirements based on the new salary schedule, it has been determined that the current S&W budget for the golf course staff was understated by $27,920. } Bi11298: Amends Ordinance No. 07-82, as Amended, the Operating Budget for the County of Hawai`i for the Fiscal Year Ending June 30, 2008. {Increases revenues in Transfer from General Fund ($79,000); appropriates to the following: Office for Social Ministry (OSM) - Mobile Care Health Project - District 1($15,000); OSM - Mobile Care Health Project - District 6($15,000); OSM - Mobile Care Health Project - District 7($20,000); OSM - Mobile Care Health Project - District 9 ($15,000); and OSM - Mobile Care Health Project - District 8($14,000), for a total of $79,000. Resolution Numbers 585-08, 586-08, 587-08, 613-08, and 618-08 were recently adopted by the Council, which transferred contingency relief funds from Council Districts 1, 6, 7, 8, and 9 to the General Fund's Transfer to the Housing Fund.
