Dear Ms. Acdal:
Sidewalk Use Permit - Colleen Mandala

We have received your letter of May 1, 1998, requesting our review of Ms. Mandala's
proposal. We have the following comments:
1. Ms. Mandala's plans show a serving window located on the building's front. The
customers would be standing on a concrete platform, a portion of which is within the
road right-of-way. The road right-of-way is property that Ms. Mandala does not own
and she must secure the owner's permission for its use before we can approve her
project and sign off on her Building Permit Application to construct such improvement.
2. The Department of Public Works is the agency which administers the use of the road
right-of-way. The road right-of-way is intended to be used for specific functions.
Ms. Mandala's proposal should also be reviewed by the Department of Public Works
and perhaps by the Police Department relative to the conflicts which may or may not
occur as a result of the proposed development.

3. The Zoning Code in Section 25-4-6 prohibits such a proposal unless the County
Council grants permission to do so.
